Yes, but if he was a part of, or even knew of, the fraud, then he could be removed by impeachment.
As far as the electoral college vote goes, votes for President and Vice President are separate. Wasn't always that way, but when it wasn't you'd end up with the two most supported candidates in the President and VP slots, which didn't work out too well.
If Biden is otherwise eligible, then he is legitimately the VP. That doesn't make him President should The One be found not to have qualified because he is ineligible. See the 20th and 25th amendments. It does make him acting President, until a Presidential candidate be qualified. That might mean President McCain, assuming he is eligible. If he's not, we have an even worse mess than if just Obama is not eligible.
There. Fixed it!
So, you are in effect saying that someone not eligible to be President, can be President. Now THAT is illogical.
I hate to break it to you, but people can be places where they aren't allowed to be and have stuff that doesn't belong to them, too. People have substances in their bloodstreams that they are not allowed to ingest, drive at speeds that are prohibited, and listen to music for which they have no valid license.
But those are not "status" or "state" things, they are behaviors. Being President is an awarded "state" or "status".
Can someone not eligible *act* as President? Well yes, unfortunately. Chester Arthur apparently did. Obama may be doing it as we chat or he may not be. Time will tell.
