— No ex post facto law OR bill of attainder.

— The right to jury trials.
— Amendment 5, “infamous crimes” being addressed by Congress.

He can at least claim that he was terminated for exercising his 1st Amendment rights. More importantly, the lawsuit will be a great vehicle for getting info through subpoenas, depositions, etc. Remember a civil suit eventually led to Slick Willie’s impeachment.

From the HR POV:
Wrongful termination, in the absence of termination to avoid paying monies that an employee is owed (usually commissions or pension), is usually hard to prove.
This especially true in an employee-at-will state.
I do foresee a really nice out of court settlement coming his way. IMAO the lawsuit is just a way of applying leverage.
