Check out Alito’s concurring opinion. This decision contains an unusual amount of squabbling over the factual record.

Were one vote away from anarchy. Im not seeing any cause for celebration either.
Aside from splintered radical nonrepresentative groups, I fear that most Conservatives, Constitutionalists, Libertarians, etc. are too "civilized" and will go quietly to the ovens. Only the left has shown vigilance. There should be peaceful armed marches on Washington instead of "Tea Parties."

Have we ever had a Supreme Court nominee that has been overturned by the Supreme Court before being confirmed? don't know. I'd bet my house we've never had one that's had 60% of their decisions overturned like Soto has. She's an imbecile, like the other 4 liberals on the SC.

So now her name will get out there and people will really see what a racist she is..Just maybe she will not be appointed to the seat on the Supreme Court..All the wonderful fire fighters and police officer(this happen to the police officers also)may now have a chance to get a promotion ahead of some blacks that do not deserve to be there. And the sky will be filled with rainbows... peace and harmony will abound!
Sorry -- I'm not trying to knock you -- but my cyncism is pretty much hardwired these days. My prediction: Repubs fold like the usual house of cards, Sonia's in like Flynn, and the great USofA continues to choke and gag on the bile of socialism while crowds of illegals and degenerates cheer in frenzied glee.

No, if Sotomeyer had been on the court, the decision would have been 5-3 instead of 5-4.
To: Abathar
Important that Souter ruled with the minority. That means that it is still 5-4 on the court on the issue when the wise latina takes Souter’s place. Who would have thought that common sense would be in such short supply on the court that you would need to count votes for it?

Alito’s concurring opinion is great! It’s a total smack-down of the dissent.
To: workerbee
Check out Alito's opinion on page 42. He says Ginsburg short changed the history of the case to make her dissenting case. Whoa.
"I write separately onlybecause the dissent, while claiming that [t]he Courtsrecitation of the facts leaves out important parts of thestory, post, at 2 (opinion of GINSBURG, J.), provides an incomplete description of the events that led to New Ha-vens decision to reject the results of its exam. The dis-sents omissions are important because, when all of theevidence in the record is taken into account, it is clear that, even if the legal analysis in Parts II and IIIA of the dissent were accepted, affirmance of the decision below is untenable."

“Waaaaaaaaaaay too many 5-4 decisions. Is our Constitution hanging on by a thread?”
Sadly, yes. The idea that four justices voted to screw those who took the time to study and prep for the test is reprehensible.

Response from Camp BamBam:"This ruling proves the current court is out of touch with the real life of ordinary Americans. We need more diversity; there was no empathy for the plight of persons of color; we need Sonia Sotomeyer to balance it out."
Taking a sobering moment out of my celebration of this decision to recognize that you may be correct, workerbee. Unfortunately, that IS probably how "Camp BamBam" will spin it... and the Republicans will fall under the Wise Latina's spell...

My understanding is that her decisions are overturned by SCOTUS 60% of the time.
This decision should up that to about 70%.

I'm glad we won this one, but the case was a no brainer. This should have been a 9-0 ruling no matter your political views. Some cases stand on their own and this was one. The four liberals on the court are noting more than race whores.

Four Supreme Court justices believe it should be flat-out legal to discriminate against white people. That’s just great.

She will still get the last laugh on the first Monday of October 2009. The American people think she is “on our side”.
