Called Sotomayor (and hispandering in general) May 1st. Despite what a few people are paid to say no matter who is nominated, she is NOT the most leftist activist judge of those being seriously considered by the administration (her background as a prosecutor, plus a non-zero number of bro-business rulings as a judge, would likely put her close to Rockefeller land, like Souter). In short, Obama nominated an older (by 4 years), unhealthier (diabetes and some unconfirmed conditions), more transparently biased, 2x affirmative-action version of David Souter (Souter is just as leftist, but stealthy about it). She will probably put in 15 years.

I was afraid Martha Vázquez would be nominated.

This is the kind of justice we should expect to see...

Sonya Sotomayor’s most high-profile cases held that the city of New Haven could disregard the scores on a promotional test for firefighters.

Frank Ricci, a firefighter in New Haven, Conn., worked hard, played by the rules, and earned a promotion to fire lieutenant. But the city denied him the promotion because he is not black. Ricci sued, along with 16 other whites and one Hispanic firefighter. After a 7-6, near-party-line vote by a federal Appeals Court to dismiss the lawsuit, the plaintiffs petitioned for Supreme Court review.

If Sotomayor is confirmed, she will again issue the same judgment she made when she was in the court of appeals.

Five of the majority judges, including Sotomayor, decided that New Haven’s decision to discard the test results and deny what would otherwise have been virtually automatic promotions to the highest-scoring white and Hispanic firefighters was “facially race-neutral.”

The reason? Because none of the low-scoring, ineligible African-American firefighters was promoted either. These five judges also endorsed Judge Arterton’s conclusion that the city’s decision was justified by fears that promoting the high-scoring whites might violate Title VII of the 1964 Civil Rights Act and bring a discrimination suit by the low-scoring blacks.

Simply because a much higher percentage of the whites than of the blacks who took the exams had passed, the majority said (adopting Judge Arterton’s opinion), the city could be “faced with a prima facie case of disparate impact liability under Title VII.”

“Most working- and middle-class white Americans don’t feel that they have been particularly privileged by their race,” Obama said in his much-acclaimed March 18 speech about race. “So when they ... hear that an African-American is getting an advantage in landing a good job or a spot in a good college because of an injustice that they themselves never committed ... resentment builds over time.”

So it does. But based on Obama’s record and the views of the civil-rights specialists on his transition team, there is every reason to worry that he will appoint MORE civil-rights enforcers, judges, and justices bent on perpetuating the race-based discrimination against whites (and Asians) in many walks of life that is exemplified by the New Haven firefighter case.

The fact that he elevated Sotomayor to the Supreme Court is just one evidence of that.

I remember Sen. Howard Metzenbaum spewing his evil when he was alive regarding SCOTUS picks. He was one of the architects of the activist court we now have.

I wonder Howard has regrets now - wherever he is.

This pick is just another godless liberal. She won't change God's eternal plan, but she will spew her evil as well. She will only bring judgement on herself.

Only liberals tout what color someone is over their qualifications.

President Obama has made a bold choice to replace Supreme Court Justice David Souter with Appeals Court Judge Sonia Sotomayor. Ms. Sotomayor, if confirmed, would be the first Hispanic Justice and would be only the third woman on the Court.

Sotomayor’s resume is impressive, including a 1993 ruling in favor of a homeless man beaten by NYPD officers and her landmark decision in 2002 regarding terrorism suspects. In that case, she determined that suspects captured on the battlefield must receive all rights afforded to American citizens under the Constitution. Her controversial decision was later overturned by an Appellate Court, but still influenced current policy.

Sotomayor is a graduate from Princeton University, where her legal theses included Race in the American Classroom, and Undying Injustice: American “Exceptionalism” and Permanent Bigotry, and Deadly Obsession: American Gun Culture. In this text, the student Sotomayor explained that the Second Amendment to the Constitution did not actually afford individual citizens the right to bear arms, but only duly conferred organizations, like the military. Instead of making guns illegal, she argues that they have been illegal for individuals to own since the passing of the Bill of Rights.

Ms. Sotomayor’s story is certainly one of success over adversity. Despite growing up in the projects, she has risen to become one of the most well-respected legal minds by the American left. Before joining the appeals court, Sotomayor was a legal consultant for the NYCLU.

Even with her meteoric rise, the nominee still believes there is work to do. In a 1999 interview with a local author, Sotomayor stated that she believed that the United States, “...may never truly be fixed. Racism and economic warfare still crush the dreams of countless second-class citizens. The unfair dimensions of our culture are staggering. You cannot succeed if you are born poor; you simply cannot.”

The nomination is expected to go before the United States Senate where Republicans may give a strong fight against what may be considered “judicial activism.”
