California felony murder rule. If you set it in motion, you’re responsible for the death. Good rule as far as I’m concerned.

If I recall AZ had the rule also. A criminal action resulting in any harm is the responsibility of the offender.

Yeah! If Mike and Steve rob a bank, and cops accidentally shoot a bystander, Mike and Steve killed that by-stander.

If someone is killed in the commission of a felony, the perp is held responsible for the death and charged with murder, iirc.

If the boyfriend had a felony conviction and was in posession of a firearm, and had been firing that firearm that night, and did, in fact, point the firearm at the officer, the charge would stand under that part of the law.

I'm not saying that is what happened, nor that I agree with the law, if I have it correct.

APPEARED to have a gun? Did he or not? If he did not, what was the crime that the “gang member” committed that participated this shooting?

He was convicted of being a felon with a gun. The question then is did he have the gun when they stopped the car or did they have some evidence he had it earlier that night. The article does not clear that up.

Still this seems like a stretch to me.

Well, I was going to get the details from the link. I guess six sentences constitutes an AP article nowadays? Sounds like he shot up some place, took off, ditched the gun, cops saw him, figured he was still armed and dangerous, etc. (I’m guessing is all - stupid writers).

Note that he was also convicted of firing a gun into an occupied dwelling. It’s safe to conclude he had it with him.

But isn’t that while in commission of a felony? Was he committing a felony when the gal got shot?

If you’ve ever fudged on your tax return you’ve committed a felony too. Does that mean the cops can shoot your girlfriend on site if she’s in the car with you?

Michigan has the same law. Two men robbed a jewelry store. The owner shot one of the men, who later died. His partner in crime was charged and convicted of homocide.

Not really, I think if he had it with him at that moment, the article might well have said that. But with the dying US press maybe not.
