Due to the gun or Taser likely mistake, BART Officer Johannes Mehserle should not be charged with murder or negligent homicide. He was a sworn officer acting in the heat of a legal arrest and made a momentary mistake.

Cool. When will the dead guy be coming back, then, if the "mistake" was momentary?

Either way, the result means a man was shot in the back and is dead. For ever. "Mistake" doesn't begin to explain or excuse this.
