Interesting situation. If the cases in question are those where a caller has reported a statutory-rape or child-abuse situation that is fictional, then I think it would be tough to make a civil or criminal case against the employees. Not reporting something that, in fact, didn’t happen?
It’s certainly indicative morally, but very questionable in a court.
Interesting point; however, there are cases of abortuaries that did fail to report bona fide statutory rapes.
Yes, that would be different, if there were an actual underage girl with proof that she’d had sex outside the law. In that case, failure to report would be a chargeable offense, within the statute of limitations.
The first of those cases looks pretty solid. I hope they nail them.
I forget the story from 10-15 years back but a 15/16 year old girl was molested by her teacher and the teacher took her to a abortion clinic to do away with the evidence. The teacher was never charged because the molestation was dismissed as ‘heresay’ and the cover-up was actually allowed under the state law. Makes me happy to see some of this getting scrutiny and I wonder how many public school molesters are shaking in their shorst right now wondering if Planned Parenthood will now rat them out?

If I believe my neighbors daughter is preggers by an adult, I MUST report it or I am participating in the crime. If somehow the crime comes to light and it comes out that I knew of it, I would be in trouble. The catch to all this is most people don't discuss these things too much and the perp gets away with it. Any doctor is REQUIRED by law to report crimes.
If you go to a doctor with a gunshot wound, you can beg and plead and tell him it was an accident while cleaning your gun, and he MUST still report it or lose his license. If a young girl is pregnant, she should be made to name the father, give DNA, and the father should cover her expenses. If everybody just sweeps it under the rug and hides the real father was an adult, the DNA would refute it and he would at least have to pay child support. If it turns out to be a teenager, then the boy's family would have to take on the burden of child rearing. Try having a wreck with a teen and see if the parents aren't responsible. At least we are in Texas.
It's perfectly all right to convict Scooter Libby of a felony and ruin his life because he didn't accurately remember to turn himself in for a crime that never occurred AND wasn't a crime at all. So screw 'em, I'd give 'em all life in prison, no parole.

I didn’t say it was “all right,” and I didn’t say they shouldn’t have reported *any* evidence of child sex abuse. What I did say is that I think it would be tough to make a legal case based on a fictional phone call to a clinic. If someone actually does establish criminal or civil liability based on such a situation, I will be happy to admit I was totally wrong in my speculation.

If the girl is underage and volunteers the info the dad is too old, the abortion clinic has no choice but to report it. To choose not to is a crime. It’s a slam dunk, no question about it. If the girl lied, she is the one under scrutiny, not the abortionist. If the abortionist stays quiet, they are in jeopardy. It’s that simple. The girl could be charged with a false report, but probably not, depending on the circumstances. If she cried rape and wasn’t, it would be like the N Carolina case at Duke. If she was saying she was in love and was trying to trick the cops for childish reasons, I’m sure that would be taken into account. No person, child or adult, can maliciously make a false report and get away scot free. No person can ignore a crime reported to them without becoming an accomplice.
That would depend on the law, which varies by state. Not everyone is a mandatory reporter, and not every situation qualifies as a reasonable suspicion of abuse/statutory rape. Anyway, report *what*, exactly, if the clinic has received an anonymous phone call? Info from caller ID or invite Social Services to subpoena their phone records and go on a fishing expedition based on the phone number?
