Hire a labor attorney and sue for mental harrassment. You should never resign - make them get rid of you so you can collect unemployment.

Thanks for the advice....I already resigned....I caved. I don't believe in frivolous lawsuits. I just wanted to get the word out to my friends on here to watch what they say at work. I would go to the ends of the earth to see Gov. McCain and Sen. Palin elected. I would love to have the opportunity to speak out, without fear of repercussions.

Sir I admire the parents that made you, The fact that you had the guts, gumtption, and ba!!$ to fight back, at least you tried. And belive me sir, IMHO opinion if you continue upon this course of “sticking to your guns” and being true to youreself, and family. Well, What else really really matters.
I admire and envy you, My Being in the Navy was no picknick, and yet, I could always, “at a certian level” in a way could cop out because I was in the navy (the so called no political voice mind you)when these things happened, Not being able to really put my a$$ on the line...
I know you may be hurting financially, due to this libtard thing (Thanks to Lawyers and other folk that do as they do) But you will always find a FRiend in me. I can’t stand the left. They suck.

Ever since Obamanation announced candidacy I knew — just KNEW how bad things would get. This empowerment thing his fans feel is huge and WILL get worse if Zero “wins.”

I told a few people back then that this was not the message I wanted to send to the masses — putting Zero in the White House that is........... In addition to everything else that we now know about Zero and his cohorts and his views, this empowerment thing that may be coming is the absolute worst.

Well, before I walked out, I had 4 “Above and Beyond” Certificates at my cube (I should have had about 20, some never found their way to me)....they give them out to the reps who are compassionate to customer having problems. Yet somehow, I was targeted, like I said before, for low performance, not on my tech skills, but on my customer service skills....?
I started out at this company as a customer service rep, and was thrown into Tech support after one week’s training. They turned the Columbus (Hilliard) center into all tech support. I didn’t know much about tech support, but did my best, and after that, The certificates for going “Above and Beyond”?...most of them stated that the customer was going to leave the company until they talked to me, and I worked them through their tech problems. Then I get targeted as one of the lowest performers, ironically one day after I made my complaint about having to listen to the Obama comments?...
OK, I’m exausted...thanks for listening all....goodnight.

I have a great deal of empathy for your personal situation and understand fully you're emotional need to terminate a relationship in which you were set up by the system to be a patsy. I do not denigrate for one minute the strain which led you to do the thing they probably wanted in the first place.

But the posters who reacted by saying that you should not have quit were correct and that is a lesson which needs to be heeded by every other reader who lands in this situation as the landscape darkens after the election.

The second lesson is that legal services are amazingly cheap when one seeks help before the inflection point. Indeed, I would wager that a review of the Internet would have sped you in the right direction. As a caution to all employees, we should document on a daily basis and confirm whenever possible by written memoranda everything that relates to job environment.

Let me add another word which I hope you do not take as being condescending in any way. Our self-worth has been established by God and is not determined, repeat, not determined by status at the workplace. This is especially difficult for men to accept when they are laid off because society identifies success for men as their ability to bring home bacon. When we try to establish our self-worth by reference to these horizontal values, we will always be disappointed. The answer, ultimately, is vertical.

I advise that you at least listen to the FReepers who want you to take an activist position on this (call a lawyer, etc.). Perhaps you are able or inclined to follow this advice, perhaps not. But you do not deserve to be treated like this for exercising your God-given right to free expression. I boil when I hear these stories of abuse-it’s just not right.

In the meantime, for what it’s worth, I will carry you in my thoughts and prayers.

I understand. Went through some heinous times with my last employer. It was so bad that I have not worked since, though I am getting older and have savings. If I had to work again, I’d try it through a temp agency.

You don’t sound to me like you want or need to be saddled with a big lawsuit — it takes years of your life from what I’m told — you have to “live with it” day to day for years; very draining, all encompassing.

I personally think you’d be better off just getting hold of your old records, performance reviews, etc. Then talk to an HR attorney in your town. Chances are you will come away with a monetary settlement and agreement to let you receive unemployment.

My old employer fired me for speaking out at a company meeting about a pet project they held dear (but gave me a settlement!) and then denied me unemployment. I told my story to my state’s unemployment dept. and they said “we get it; you deserve the money” and I got the funds immediately.

My point is I don’t think you are up to a huge battle with these people. I’d recommend not going the full lawsuit route.

Thank you for your response. I would like to tell the world how I feel. I think my freedom of speech was suppressed, and with an Obama administration, I think it would only get worse. I just wish I could shout my feelings from the rooftops. I feel like my hands are tied behind my back, and I just wish I had a way to get my thoughts out.

Lisa, there is no doubt that what happened had NOTHING to do with your work performance.

I’ve sent you a couple of other e-mails about this — if you want to write me back, feel free — I could’ve filed a big lawsuit against my company but decided it was not worth it. I am SO happy now that I didn’t do it, but AM glad I spoke to an attorney and that the company got a letter from the attorney. Often that’s all the company needs to shape up and give you what you should get: a settlement and uncontested unemployment benefits.

Find a good lawyer immediately, have them sue your former employer for harassment, as well as something called constructive discharge, which is the term applied by the the Equal Employment Opportunity Commission when the conditions of a job become so intolerable that an employee is forced to resign. Unfortunately, EEOC could not or would not represent you in this action since they only deal with alleged violations of Title VII of the Civil Rights act of 1964. Unless it has been amended to include additional bases, that law is limited to discriminatory acts by an employer based on an employee’s race, religion, sex, color, or national origin. The courts have recognized constructive discharge, and ruled in favor of Plaintiffs on that basis, for at least 25 years. I urge you not to just let it drop and I will certainly keep you and this country I love so dearly in my prayers because I keep hearing more and more of these reports almost daily.

I think it’s really time to start keeping a database of these companies, naming the company and the offending people. Really - if this is stolen by Obambi, we’ll want to stop doing business with any company that sought favor with the communist. Granted, you’ll have a few employees in any workplace that are just dumb enough to vote for him, but when the atmosphere is so blatently pro-Obama and/or anti-McCain, they need to be blacklisted.

Long story, but the harassment was actually toward my 18 year old son, who worked there for a few months, by his homo production manager (Never, EVER get between a mother and her threatened cubs, regardless of the age...!). We recently settled for a small amount, mainly because we were both sick of it, and they had "big guns" for lawyers. It had already been a year, and it's draining on the soul.

I didn't take a dime, it all goes to my kid (I was forced out also), as that was tough on him, especially at that tender age.

I miss my old buddies, though. Can't put a price tag on that.

I'm fortunate in working in an environment where I rarely have coworkers, since I'm in field service. I do have to listen to stupidity from customers employees from time to time. I've learned to size up the audience and generally limit my comments on Obama maniacs to a facial expression that indicates my belief that they are an idiot. It may not be as satisfying as a verbal confrontation, but I know I've won. See the tag-line.
