Actually I think he will. This case is of such high profile that the prosecutors will use it as an opportunity to let the world know that this is not behavior that will be tolerated. It's sort of like the IRS prosecuting the rich and famous a couple of months before April 15.

Unless he wiped his drive, the evidence will still be there even if he deleted it. Even formatting the drive will not remove all of the traces, but it doesn't sound like he was that sophisticated. He was basically a "script kiddie" who knew how to use an internet proxy and could google the answers to Sarah's security passwords.
