Yadda, yadda, likely story. Fact remains, Kanof and Gonzalez brought up baton and pepper spray. The use of the shotgun was appropriate and according to the decision on the use of a gun even that use of a shotgun would have resulted in the 10 year penalty. And there were more witnesses to that than there were to the shooting by Compean. Nope, the use of the shotgun was appropriate.

The unpredicatble nature of gun fights often makes lethal shots unlikely or impossible. In such cases, shots that an Agent reasonably knows are going to wound the perpetrator are authorized. That is one of the reasons why Agents are told to shoot to stop the threat rather than shoot to kill.
