Venue restrictions are to be done by legislation, not by whim of the executive. The executive branch only enforces the law as written, it does not make the law.

I agree that eventually Phelps will face judgment for his sins. I believe it will not be a pleasant experience for him.

OK, if what you say is true, then please tell me why, there have been NO lawsuits brought against them for “hate crimes”, discrimination, etc, by the ACLU or homosexual activist groups? Zero! Do you not find that suspect?

AFAIK, these people have committed no crime or any tort against anyone. Being gay-hating, venom-spewing scumbags isn't a violation of any law and I can't think of any cause of action for them to be sued under.

A lawyer filing a lwsuit against these people for their vile, but Constitutionally-protected, actions would run a very real risk of being sanctioned by the courts for filing a frivolous lawsuit.

I hear that, but at the same time the ACLU and homosexual activists or even single homosexual or couples, have sued people in the general public for a lot oess. Like not photographing their ceremony, not renting a hall to them for a celebration, people have been fired as well as sued for speaking of the policies against their religion, on homosexuality. These happen all over the country. Communities everywhere have ordinances against ANY negative speech (or perceived negative by homosexuals themselves), and Christians or even secularists are forbidden from saying anything about the laws in their communities. Yet these folks can go over the top?? I don’t buy it. Were they not part of the left, they would be shut down. Much like Jessie Jackson being able to say anything he wants that NO white person could get away with.

That's a little different- I don't know of any case where Phelps and his people have committed any form of discrimination against anyone, so that's not an avenue for a lawsuit.

Sure, but it seems like the Phelps make money off of suing people- they're basically self-employed in their own law firm, AFAIK.

I think you might be thinking of cases in other countries, but no such laws exist in the US because they are blatantly unconstitutional. Phelps' speech is constitutionally protected and there aren't any real legal ways to shut them down.

There are plenty of groups in this country, from all over the polticial spectrum, that espouse hate of one thing or another. Phelps and his crew are toxic, but they're not particualrly noteworthy.

Well, I drove down to DC this morning. I arrived in the vicinity of the Immaculate Conception about 9:45AM.

The whole area was under very tight security. Lots of CUA police and SS around. I was not allowed to get very close to the church itself.

I walked around the perimeter of the church grounds. I didn’t see anyone. No Phelps thugs, no DC Chapter.

I could have attended the funeral, but I was not dressed for it (that’s not why I made the trip down). I did see quite a few people walking in close to the start time of 10AM.

One woman asked me about the funeral. She first asked who he was and how old he was. She then asked about what Tony Snow had “done for humanity.” I told her about all of the terminal cancer patients contacting Tony for words of encouragement and finished with the words that he was a decent man.

Being able to give witness about him alone made the trip worthwhile. ‘Pod.

Thanks for taking the time to go down to D.C. to check things out and giving witness for Tony.

Phelps was right to go early before any one showed up. He would definitely been chased off by police or pushed back where he would have been marginalized.

I’ve noticed that Phelps has not shown up where he reads about the negative public reaction to them. Seems like he knows with Patriot Guard and the public that we will block the view between the grieving family and their group. It is beginning to be a waste of plane fare to go to some funerals.

Funerals need to be OFF LIMITS for picketing or any other political/religious protesting. That is a private thing, have RESPECT and DECENCY, for cying out LOUD!
