They should sue Steven Ceballes the noisy guy that caused all their problems in the first place. I would make him pay all their legal bills if I were on a jury, including the cost to sue him for damages.

I don’t know about AZ law, but in CA, “driving under the influence” doesn’t mean a particular blood alcohol level; it means you are impaired and cannot safely operate a motor vehicle. Showing evidence of a .02 BAC wouldn’t save her in a CA court.
