As a parent of private school children I am VERY confused. Why doesn’t the school just kick them out? How can they even be sued?

The parents claim in their lawsuit that since the school receives federal money for its free and reduced-price lunch program, it is subject to federal anti-discrimination laws. The district contends it is the students who receive the federal funding.

“Can illegals sue?”

Perversely, they can.

I feel like such an ass.

Oh, I think it was worth bringing it up again, and reminding people that if a private institution accepts *any* funds that originate with the government (even government-guaranteed loan funds), it is no longer a private institution.

School voucher proponents take note. A school that accepts vouchers will not be allowed to have an English-only policy, if someone decides to sue. Will not be allowed to teach a religious faith that views (choose your vice) as a sin, if someone decides to sue. Etc., etc.

The Catholic church is now beginning to reap the fruits of its support for illegals.

You should seriously consider a career in the liberal mass media since you ignore what the actual teaching of the Church is regarding illegal immigration and try to pass off the incorrect prudential statements of some of those in the Church as official policy.

2241 The more prosperous nations are obliged, to the extent they are able, to welcome the foreigner in search of the security and the means of livelihood which he cannot find in his country of origin. Public authorities should see to it that the natural right is respected that places a guest under the protection of those who receive him.

Political authorities, for the sake of the common good for which they are responsible, may make the exercise of the right to immigrate subject to various juridical conditions, especially with regard to the immigrants' duties toward their country of adoption. Immigrants are obliged to respect with gratitude the material and spiritual heritage of the country that receives them, to obey its laws and to assist in carrying civic burdens.

The school that my kids attend is the designated ESL school for the entire school district. Any elementary age, non-English speakers MUST attend this school (in addition to the regular kids, like mine) and become age-proficient in English before they can move on to their geographically-assigned school.

It is nothing short of a nightmare, all thanks to NCLB. The ESL students are in the classrooms 3/4 of the day; the remainder they spend with English tutors. A lot of the children, particularly the African and Iraqi kids, are eager to learn English and very seldom speak their native tongues. The Hispanic kids are a different story altogether. They make very little effort to learn English, and yet, because of NCLB, they are expected to be doing the same classwork as the English speakers. Lessons grind to a halt almost continually because of a handful of kids. They're not in over their heads, they are just willful in their refusal to learn the language. All the kids pay the price for it.

This is not a private school, not a parochial school, but a public school, and allowing the kids to speak their native tongues freely has turned it into a cesspool. All of my children are going to magnet schools next year. I can't wait until they're out.
