This Memorial Day will also make the second anniversary of Congressman Murtha's media blitz: perverting a sacred holiday for political gain in a mid-term election.

We've seen five Marines charged and cleared over the past seventeen months. Thoughts and prayers are with the families of the three remaining accused.

I have always believed that those images should have been deleted. It is illegal to have contraband photos of the dead for prurient reasons. Laughner is protecting himself by pointing his finger at someone else. I wish Lt Grayson had charged Laughner rather than just order him to delete the photos.

Prayers lifted for Lt Grayson in this time of trial.

Wow! Thanks for the ping. This is an excellent, well-written piece by Nat Helms, and an excellent summary of one part of the story of how an insurgent propaganda scheme led to a surreal nightmare for a bunch of heroic Marines.

By the way, this is the first I’ve heard of Kasperczyk. Apparently the Marines have no shortage of cowardly weasels among its hordes of lawyers. Of course (and I don’t care if I’m getting obnoxious about this) all the ultimate weasel has to do to end this sick nightmare is pick up the friggin phone - - THANK YOU, Commander-in-Chief George W. Bush.

Aye, chaplain. And the fact that others also told Laughner to delete the photos make this prosecution all the more ludicrous.

Also, Lt Grayson's prior service record is a big problem for the prosection. He is a good Marine with absolutely no motive to conceal anything. Lt Grayson didn't even know the Marines who fought in Haditha that day. He had zero reason to cover anything up.

What? Lovable old Lancey being obnoxious? Never! It's good you speak your mind.

I can't imagine there are enough weasels in the Corps to fill a jury box (let alone three for each court martial). So I can't imagine anything but a swift acquittal.

I agree. Having the ranking NCOs previously telling the guy to delete the stuff, and having stories of the photos being all over the battalion, looks good for Lt Grayson.

They were spread for prurient reasons, and the fact of their spread is exactly why the LT should have ordered them deleted. And especially if there were inspecters coming.

It’s stupid to have anything out-of-line if you’re told ahead of time that inspecters are coming to inspect. That’s why you get told.

It strikes me as an error of law to include the DD214, Discharge paper mistake, with this case. I think it has nothing to do with the facts of the case, and it would prejudice against the defendant. It is a separate issue.

Wouldn’t that insure this could be appealed?

I agree completely, and I only hope nobody is playing games filling that jury box.

At least he finally will get his day in court. They have nothing on him and have botched the case. He should walk free.

During Grayson’s Article 32 evidentiary hearing Laughner testified during cross examination by Casas that he had also been ordered to destroy the images by two senior non-commissioned officers on his team within days of taking them because they had no intelligence value.

I didn't realize there were others who had ordered these photos destroyed prior to Grayson. Why was only Grayson charged with obstruction?

I don't see how this case can stand. There are so many holes in the prosectutions claims, a jury will probably spend ten minutes reaching a decision before completely exonerating LT Grayson.

The fact that others had given Laughner the same order only came out during cross-examination in the Article 32. Seems that investigators and prosecutors never probed this because they were myopically focused on Grayson.

I'm reminded of the Dr. Sam Sheppard case. In his closing statement, defense attorney F. Lee Bailey told the story of a woman who, late one night, was searching the ground under a streetlight. A man stopped and asked her what she was doing. She said she had lost a dollar across the street. He asked why she wasn't looking over there. She replied that the light was better here.

Investigators often only overlook the obvious because their light is already shining in one direction. And that's what it sounds like in this case. Why the prosecution didn't just fold up its tent and drop the charges after the Article 32 is a mystery to me.

That's my read, too, smooth. I've always been cautious about predicting verdicts, but I can't see any other outcome but swift exoneration.

Once again, Red - thanks for this post and thanks to Nat for a great article.

It breaks my heart that the Haditha Marines and their families have to continue living this “nightmare” - and believe me, I know firsthand, that IT IS A HORRIBLE, HORRIBLE NIGHTMARE!
