“Under what right/authority?”

American law does not preclude an illegal from filing a civil lawsuit. I wish it did, but it doesn’t.

“What country does OUR government work for?”

The government hasn’t worked for the United States since 1860.

“It doesn’t sound like this guy was obeying the law.”

Where in the U.S. are illegals penalized for breaking the law? Mostly, they’re just ticketed and let go, free to break the law again, and never paying up on the ticket.

"The citizens of New York should initiate a class action lawsuit against Bloomberg for NOT enforcing the law."

Better the citizens of the US should do this to the Federal Government.

Policy however, is not the law.

You're right. Bloomburg might fire the cop for insubordination, but he didn't break any law. And as for the illegal alien suing the cop, I don't see how an illegal alien could have any expectation that at any time or any place or for any reason he wouldn't be caught.

Under section 642(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, a “Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.”
