No, I did read that and though one might infer that this means she was illegal, it does not mean that she in fact is. It only means that the people involved threatened her with that action.

But, she should not get any money when she's the one who broke the law first.

I would respectfully disagree.

She should be able to sue and collect damages for the abuse suffered. She should also, if here illegally, be deported and/or incarcerated as the law may allow.

One illegal act does not always negate the ability to receive compensation for another.

Example: A person gets their driver's license suspended for a speeding ticket and while under suspension, illegally drives to the supermarket. On the way there he is struck and injured by a drunk driver.

Is he entitled to compensation for damages?

I say he should be punished for his illegal act and should receive compensation from the other driver for the damages caused.

Yes, but she overstayed her visa.

She becomes illegal once her visa expires. It does not state that she was given a new one.

And how was she going to get her visa renewed under those conditions?

Besides, so what if she was illegal? She still should be compensated for the mistreatment.

She should have no standing in court because she is here illegally. Period.

She came here legally and was apparently prevented from extending her visa. She has standing in a court of law.

I wasn’t talking about the law.

She could have gone to the police at any time. Illegal aliens are bringing crime into neighborhoods with just this behavior. They should not get rich from it.

Tell it to the judge.

She’s a grown up, when her visa expires she either has to renew it or leave.

The employers are clearly utter scum and should be locked up for a very long time but that doesn’t solve the woman’s legality status.

She has a good argument that she was imprisoned illegally and could not meet her legal obligations and maybe she could get some dispensation to get a new visa but she would need a new employer to sponsor it.

I agree that she should be compensated for her work ( and her imprisonment), especially if she came originally on a work visa.
