Thanks for the advice.
I pasted in the last paragraph of the decision because that’s the one that tells people to do things (the rest is deciding that the law is unconstitutional, but that tells nobody what to do). The decision enumerated that the Superior Court do something, and gave 180 days for the legislature to act if they wanted to . It told or ordered nobody else to do anything- if it did enumerate any other action by any other people, I can’t find it.
Nope. The county clerks did. They had to give marriage licenses to gay couples or else they would be in violation of the Supreme Court decision. If they hadn't complied, the court would have sent Marshals out to enforce its decision.
Yeah, those county clerks sure messed things up for the legislature. The supreme court in Massachusetts has a whole barracks of marshals they send out whenever the state constitution is violated and since the clerks were told by someone (by executive order) they had no choice. Who issued that executive order, and on what authority?
What do you suppose would have happened if the legislature said, OK, we have 180 days, let’s get to it?
What do you suppose would have happened if the governor had said to the legislature, OK, we have 180 days, let’s get to it, I have a plan? I am your leader!
When the State Senate refused to vote on the marriage amendment ballot initiative, were the marshals able to get into the senate chamber to force a vote, or were they held off by the capitol guards?
I understand your need to believe that Romney was helpless and had no other choice. That’s OK by me.
