How does thia putz and co-putz Fritz Hollings keep getting elected? Don’t their constituents (the real ones, not Disney execs) hate them as much as everyone else does, massive campaign contributions or no???

If it’s on your PC it can be seen. Depending on format and code they can tell whether it’s a legit download or cd rip.

A while back the RIAA was seeking permission to snoop personal PCs.

And the statutory damages you get for that one willful infringement will probably make it all worth it.

BUt what are the odds that the RIAA will actually get its million dollars from hat woman on the reservation? She doesn't have a fraction of that. Once again, they spent half a million in legal fees to get nothing. Let's arrange for this to happen another hundred times or so.

Exactly how, I can’t tell you because I don’t know.

I know one thing. If you can passively download through firewalls, one with proper equipment, can likewise get through them. Windows boxes probably easier than Macs.

Do you think they’d ask for permission if they could not do it? I’m betting they already were, and just wanted to be able to file suit on what they were finding.

I don't think so, unless you're referring to passively uploading, as in people copying songs from a shared Kazaa folder on your machine. Even then, the post to which I responded to made it sound like they can see the entire contents of your drive while Kazaa or similar shares only a given folder or folders you designate, AFAIK. (Admittedly not an expert either)

None. As I said earlier, their purpose isn't the money, but to terrorize people into not sharing. They don't really want a trial, just the terrorism. Notice how many times they've dropped suits as soon as the opposition got heavy? They don't want any precedent against them, any chance people might think the RIAA may be wrong in their extortion tactics.

Also, have you seen them sue any rich people? No, they're going for the average person who can't really afford a high-priced defense. Most of the current ones that are getting a pro-bono defense are barely getting free fees -- they can't afford the expert testimony and serious discovery, which is why their attorneys are over at Groklaw asking for free technical advice.

Fat campaign coffers. That's all it takes. Plus those working in Hollywood probably value their jobs over constitutionally-correct copyright.

But Hollings was from South Carolina. He had to get elected by actual voters with actual jobs. Now Berman is a different story, and your explanation makes perfect sense for him. He literally represents Hollywood, so no doubt a lot of people connected with the industry as well as people who think what’s good for the industry is good for their town and their pocketbook.

Well, obviously "they" can see the files if someone is offering them for sharing, or has no port protection with everything wide open. If not, and the user has a properly configured firewall, there's really no chance they can see drive contents without a court order. Current firewalls, properly patched and configured, are solid. Also, protocols are directional, so even if I can connect to an FTP server (for example) from my machine, it doesn't necessarily mean you can connect to an FTP server on mine.

Actually, the ultimate control the RIAA could dream of would be a special ‘headset’ that would allow only those who buy it to hear ANYTHING recorded! This is about controlling the transmission of sound and preventing free hearing! Incredible!

I highly recommend not only copying whatever music you have, but MAILING the CD’s to everyone who might like one. A massive free music CD mailout would make the RIAA nuts. What are they gonna do, post ‘watchers’ at every post office, every mail drop? Let’em try to police the US mail! Use one bureaucracy to kill another!

FWIW- I’ve never downloaded one piece of music from the net. Would like a few things, but just never bothered. Not much worth copying, IMO. CD’s I own- that’s something else. I paid for it, I own it, and I’ll do whatever I damned well please with it!
