U.S. District Judge Paul Huck is a bright, disciplined and all-'round excellent judge. I've known him for many years and know he's a straight shooter from the Bench. Jack Thompson forgot or ignored the proper role of an attorney; we are not the client. While we may see a public wrong that needs to be addressed, we have the professional obligation to address it with decorum, respect for the dignity of the court (akin to the rendering of a military salute to a ranking officer who, though he may be a miserable SOB and incompetent, has an emblem on his collar or shoulder that's entitled to respect).
In asserting the most fervent wish of Mr. Thompson he owed the public and the legal tradition the duty to sublimate his enthusiasm and present the case within the confines and limits of the system we've taken an oath to uphold, support and defend. We lawyers are not free to roam the lexicon to express our disdain for the adverse counsel or the court while seeking to cloak such outbursts in the mantle of the absolute immunity that protects arguments and statements made within the judicial system that, if made by a person outside of the system, would be libelous or defamatory.
Decorum and fairness of the process are necessary to the public trust in the judicial system for the resolution of controversies without resort to extra-judicial self-help. Jack Thompson's antics have impaired that trust and, if allowed to exist without sanction by the Florida Supreme Court, would imply the imprimatur of approval of that inappropriate conduct.
