"NOV 06, 2002 Thune's slight lead slips away in late counting By Peter Harriman and Kevin Dobbs, Argus Leader A mere 528 votes helped Sen. Tim Johnson hold his seat against a challenge from Rep. John Thune in a brutally close race for which the final ballots were not tallied until after 9 a.m. today. The closeness of the vote makes a recount likely, and state officials said it would be held Nov. 25. ... "
from
Tim Johnson for South Dakota
Another Democrat who won with "last minute" votes. Always just enough...
No, we don't need to show "bipartisanship". The Democrats will steal every election that they can. The Republican governor would be justified in assuming that the people of SD really wanted a Republican.

I hope he recovers - still, while trying not to be ghoulish and tacky, what party is the governor of SD (who would appoint his replacement)?
As pointed out, he's a Republican. That said, if Johnson is unable to recover (let's hope he does), and he appointed a Republican, you could pretty much kiss the GOP goodbye in South Dakota in the future.
Chances are he would appoint a conservative Democrat - the Governor is a professional politician, and wouldn't ruin his career over this.
Plus, the position would be up for grabs either (depending on which talking head you listen to) within a special election in 90 days, or in the next General Election - 2008. Either election would have the dems fully mobilized if a Republican was appointed.

Here's hoping for a speedy recovery.

12-11-1. Special election to fill congressional vacancy--Time of election of representative. If a vacancy occurs in the office of a senator or representative in the United States Congress it shall be the duty of the Governor within ten days of the occurrence, to issue a proclamation setting the date of and calling for a special election for the purpose of filling such vacancy. If either a primary or general election is to be held within six months, an election to fill a vacancy in the office of representative in the United States Congress shall be held in conjunction with that election, otherwise the election shall be held not less than eighty nor more than ninety days after the vacancy occurs.
From what I have found, there is no provision for appointing a new senator if he is incapacitated. An appointment happens in the case of either death or resignation.

Is being unable to attend any sessions a vacancy. What about a coma?

Well, that is good and bad seeing they don't know what is wrong with him. Obviously something is!

Flu? Vertigo? Tumor? It would seem that any of the above could cause "stroke-like" symptoms. Hopefully it's something relatively innocuous.

This is about two potential Supreme Court nominations between now and 2008, if rumors are true that one justice has a grave illness. We can't wait until 2008.

Who cares at this point about bipartisanship? Would a democrat show it? Noooooo. I pray he gets well, however. Strokes are not nice.

I do know for a fact that after Preston Brooks beat to a pulp Charles Sumner in May of 1856 Sumner's seat remained empty for three years (he was reelected in the interim) as a symbol of the pro-slavery's advocates "viciousness".
To: pulaskibush
South Dakota law only references death or resignation. If he were incapacitated, I am certain the Dems would file suit if the Governor tried to name a replacement.
