Thanks for the update.

Gower said the county attorney was not planning on prosecuting the boy. "We feel pretty confident it was justified," Gower said.

Until the guy's family files and brings charges the murder was planned because the kid had a hunting knife under his bed.

Or how about, "Some days it just proves that you should have stayed in bed".

I wonder if some lawyer will get into the scene and get the family of the stabbed victim to sue the duct tape manufacturer, claiming that weak tape led to his killing.

The only thing the kid screwed up on is that he probably should have gone outside, found the body, and pulled it back inside the house. Then call the police. They will most likely get sued.

That would have not been a good idea. It would have been obvious. Meanwhile with all the blood in the house, and the trail leading to where he collapsed, the sequence of events would be plenty obvious. The man was in someone else's house in the middle of the night. That alone is grounds for using deadly force. At least in Texas, and I suspect in Utah as well.

unfortunate misguided socially deprived child"

You forgot the adjective of unemployed (ya know, it was Bush's "high unemployment rate" that was at fault, as we all know that financial insecurity is the root of all evil)

Gower said the Iron County Attorney's Office wasn't planning on prosecuting the 17-year-old boy. "We feel pretty confident it was justified," Gower said." Duh! That's an understatement

As W.T.R. says in post #35, the kid could be charged in the UK...and even in the U.S., how often have cases comes up where people who have repeatedly shot an intruder in the back were not only tried but convicted? I can't think of exact cases on the tip of my tongue, but I know the fact that because these intruders were fleeing (as a shot in the back indicates), it makes it "prosecutable."

The investigators may conclude, "Hmm...we wonder if the kid was chasing the perp out the door and continued to stab him beyond the initial contact? If so, we've got a trial on our hands."

I saw the knife part afterwards but the kid was still technically an *armed citizen*. So backatcha, HA!

" Sheriff Says Teen Saved Family by Killing Intruder.

Police in southern Utah are calling a 17-year-old boy a hero after he fatally stabbed an armed intruder who broke into his family's home early Wednesday."

SNIFF !!! I always cry at good news ...

The title of this story should have been "Duct Tape Failure Results in Death of Man". There, I fixed it for the MSN folks.

Great! Now the lawyers for the "perps" family will get involved, suing 3M or whom ever made the duct tape. If it hadn't been for that failure, their little angelino would still be livin' la vida loca

Or how about:

Bush Administration Blamed for Death in Faulty Duct Tape Case

A bright, young Utah entreprenuer died today as a result of duct tape failure believed to be the result of the Bush Administration's pathetic Homeland Security policies. When Bush officials recommended duct tape as part of every families' emergency response kit, Bush failed to adopt regulations to assure that duct tape being sold to unsuspecting, helpless Americans was strong enough to do the job. Now, as a result of this reckless indifference, a promising young life has been senselessly ended.

Oh, yeah, I guess we should mention that the victim was robbing some people at gunpoint in the middle of the night or some such thing, which is obviously the result of the Bush economic policies which leave young people with little choice.

Now, back to DailyKos.

There must be something in the water in Southern Utah, but the Police are pretty good about us when we defend what is right. ... for example

Father Beats Up Man Suspected of Molesting Daughter
August 7th, 2006 @ 4:23pm

(KSL News) -- Saint George police say a father beat up a burglary suspect who's accused of molesting his three-year old girl.

Eugenio Vichi Tapia was booked into Washington County's jail on suspicion of aggravated sex abuse, burglary and intoxication.

Police say he walked into an unlocked home on Saturday, intending to burglarize it. Officers suspect he then saw the three-year old girl and decided to molest her.

The girl's mother found her daughter in the bathroom with the man hiding in the shower.

She ran to find her husband, who beat the man until police arrived.

The father does not face charges.
