Until the guy's family files and brings charges the murder was planned because the kid had a hunting knife under his bed.

I wonder if some lawyer will get into the scene and get the family of the stabbed victim to sue the duct tape manufacturer, claiming that weak tape led to his killing.
That would have not been a good idea. It would have been obvious. Meanwhile with all the blood in the house, and the trail leading to where he collapsed, the sequence of events would be plenty obvious. The man was in someone else's house in the middle of the night. That alone is grounds for using deadly force. At least in Texas, and I suspect in Utah as well.

You forgot the adjective of unemployed (ya know, it was Bush's "high unemployment rate" that was at fault, as we all know that financial insecurity is the root of all evil)
As W.T.R. says in post #35, the kid could be charged in the UK...and even in the U.S., how often have cases comes up where people who have repeatedly shot an intruder in the back were not only tried but convicted? I can't think of exact cases on the tip of my tongue, but I know the fact that because these intruders were fleeing (as a shot in the back indicates), it makes it "prosecutable."
The investigators may conclude, "Hmm...we wonder if the kid was chasing the perp out the door and continued to stab him beyond the initial contact? If so, we've got a trial on our hands."
I saw the knife part afterwards but the kid was still technically an *armed citizen*. So backatcha, HA!

(KSL News) -- Saint George police say a father beat up a burglary suspect who's accused of molesting his three-year old girl.
Eugenio Vichi Tapia was booked into Washington County's jail on suspicion of aggravated sex abuse, burglary and intoxication.
Police say he walked into an unlocked home on Saturday, intending to burglarize it. Officers suspect he then saw the three-year old girl and decided to molest her.
The girl's mother found her daughter in the bathroom with the man hiding in the shower.
She ran to find her husband, who beat the man until police arrived.
The father does not face charges.
Hopefully they stopped for donuts and coffee on the way. |
