I cannot understand why the US Attorney did not appeal Judge Ronald Lagueux's (a Reagan appointee!) decision but I'm glad the state AG was ready to intervene. Perhaps there was agreement between the state and Feds that it was better to nail Day in state court than risk an acquittal on appeal.

I do hate the idea of federal prosecution in this case as it just further weakens states' rights and expands the federal bureaucracy.
I believe what freedoms we have would be evn fewer under a totally monolithic gov't.
That is why I also oppose combined city/county,so called unigov areas like Indianapolis.
AT least with multiple agencies they can have turf wars and there is the possibility of one or the other actually helping the citizen.
