It's certainly legal. It's also dishonest. It is dishonest if you say, "Hey, dude, I'm definitely not secretly making an audio tape of what you're saying!" But not dishonest under any other circumstance.

Hmmm... why would there be any expection of being "off the record" or private at the meeting of Ministerial Association?
If the Pastor was free to repeat what the Senator said, then he would certainly be free to tape it.
The only trouble I see is he should have made sure the hosts did not object.
