The correct conformation margin is 60-40. A vote of 61-39 would indicate that we could have nominated a guy who was slightly more of a Constitutionalist.

I am going to disagree on the filibuster as they know that they will lose it if they try.
Alito will have a filibuster proof vote. We knew that Mikulski would vote no. Why is Ben Nelson saying this morning that he will vote yes?
Answer- because he will get in trouble with his constituents if he votes no.
Even Sheets Byrd will vote yes. He has to or he risks his reelection
