Not just the bots. Torie too. It is a matter of due process and simple fairness. Miers has a right to present herself in her own words, and discuss her prior words, if she so chooses. Internet chatter is fun, but at the end of the day, it should be kept in perspective. Trial by internet is not a part of the common law. After the hearings, if we get there, then let rip, either way. That is my best advice.

And oh yes, whether or not the hearings hurt Bush or "Conservatism" doesn't interest me, in the least. Miers does not deserve a lynching on either ground. That is simply wrong.

Face it, this nomination is pathetic. What evidence is there that she is even a RINO let alone a conservative?

We are really teed off because this nomination is a farce.
Roberts was supposed to replace O'Connor = Fine. Great pick. It was a move to the right.

When Rehnquist died, who was a conservative, Roberts was switched to replace Rehnquist. Status Quo pick.

Now that Meirs is replacing O'Connor, what did we gain? Nothing at all.

Nope. There is a whole nation-full of people who don't even know Miers' name. This little "oasis" here at FR is hardly representative of our nation. In fact, it's one of the most Conservative places on the planet, and she's holding her own here.

Face it, you're preaching to the choir and convincing yourself that your "tempest in a teapot" is having any effect at all.

If she can answer questions in an way that she understands the nuances of the Constitutional debate, the prior important cases, and the competing theories of interpretation, and its inherent tensions, that she has brain, and a finely honed one, then yes, absolutely. Bush has a right to appoint a "moderate/O'Connor/who knows" if he so chooses. If she comes across as a mental mediocrity, and unable to grasp despite the cramming, and the murder boards, the assorted and sundry and abstract issues, if she seems unable to understand the questions, and respond to them coherently, then I will oppose her, in capital letters.

I hope that helps.

PS: I suspect she is a quite reliable vote against Roe (even while comfortable I suspect with quotas as being constitutional). But no, that is not a litmus test for me either. I simply don't want a Carswell on the court. Period.

The nominee may be a rolling epiphany. Gore to Bush to Hecht to Scalia. A triple play. Keep an open mind.

Too many contrary indicators and virtually no favorable indicators, in comparison with others available. For better or worse, I've seen and interacted with many feminists up close and personal. With Miers, all the warning bells of a closet feminist are clanging off of the wigwag (apologies for the mixed metaphors ;-).

If she had an "epiphany," then where are the transcripts of speeches in which she repudiates her earlier views?

Also, there has been a tendency with the White House PR to take advantage of favorable breaks, even if baseless in fact. See, for example, early reports on her Catholic upbringing. That tells me the WH is desperate to keep Miers afloat and will grab anything, even if there is a chance it can later be proven false.

A strong candidate would gain momentum and would actively seek to dispel baseless rumors. Miers isn't doing that. The PR has been on the defense since day 1, and it does not seem to be getting any better with time.

Given what is known so far, a the coming out of the closet of a stealth liberal is more likely than an epiphany, which sounds as if it is wishful thinking, and in any case is a belief-based argument. Even if an epiphany miraculously occurs, it would stand in stark contrast to her prior public record. Trust, but verify. If Miers has the juice, produce the track record that shows it, otherwise put her back on the sidelines and get someone with a real track record on strict constructionism in the slot.
