My guess is that he isn't. This photo was posted on FR and taken at the protest on the 24th in D.C. If Media Benjamin and her ilk aren't behind bars for putting out a public statement supporting the insurgency my guess is that not a soul is going after this guy either.

That would be the person holding it. What is even more disturbing is that idiots like this are never highlighted by the MSM.
