I doubt the President would elevate a current Justice when Rehnquist retires. Why on earth would he want one more confirmation battle than he needs? For that matter, why would either Scalia or Thomas put themselves through that? Other than assigning the writing of opinions, presiding over the impeachment of a President, and prestige, the Chief Justice slot means no more than any other Justice.

McCain trying to preserve his legacy; he's delusional if he thinks there won't be a filibuster. If it's a conservative appointment, it will be filibustered, imo.

And as usual The link (if you can stomach NCLR), This and his Anti-Gun stance is all I need to know about Gonzales.

I don't know anything about Edith Brown--you're the expert here. I have a feeling W already knows who he will be nominating, he's just going to let the Dems and Msm "misunderestimate" him! Just as he went along with looking for a VP--and chose Dick Cheney. He probably had him in mind all along. It will be fun to watch the Dems in hysterics and "demanding" to have a say.

Why will replacing O'Connor be such a bitter partisan struggle? And why is it so important to replace her with a reliable conservative? Many people know about her rumored in-chambers 1992 decision to change her vote in Casey v. Planned Parenthood, which saved Roe. But consider some more recent decisions in which she served as a swing vote.

Stenberg v. Carhart (2000): O'Connor abandons Kennedy, Scalia, Thomas and the Chief to strike down Nebraska's ban on partial-birth abortion.

Lawrence v. Texas (2003): O'Connor and Kennedy provide the swing votes to rule that Texas cannot constitutionally outlaw sodomy. Many scholars fear that this decision sets the stage for the Supreme Court to creat homosexual "marriage" in the near future.

Gratz v. Bollinger and Grutter v. Bollinger (2003): O'Connor's schizophrenic swing vote results in a split-the-baby approach to race-based preferences at public universities.

McCreary County v. ACLU (2005): O'Connor provided the fifth vote to hold that some public displays of the Ten Commandments violate the Establishment Clause.

BTW, if you haven't guessed, I fall the in the Conservative Republican mold that understands you don't always get everything you want but you keep on trying and never fold up your tent and go home. If I was the type to fold a tent, I would have left this site in recent months but I have chosen to stay and fight the naysayers and doom and gloomers that are now populating this site. They have risen from the ashes of 2000 to be joined by newbies or at least new screen names from 2004.

To avoid looking like whackos, we may want to wait for the nomination. But then, by all means, telephone hourly, email and drop faxes and letters daily. This is why God made constituents - we've got to fight for this. And we need to call the Dems, too, not just the Republicans and raise h-e-double-hockeysticks with them, too!
