"like a turd that won't flush" is probably the best single description of the Clinton legacy anyone has ever come up with. Congrats!
But I don;t think the germane issue is the "right not to be offended", Constitutionally guaranteed or not.
I'm not a lawyer, but this seems a classic case of eminent domain. The government has always given itself the right that supercedes all other's rights, to move in on even private property and take it over for its own (usually unconvincingly expressed) purposes. Eminent domain is not a two way street---no private citizen can say "I was here first, so I have eminent domain". Ordinarily (at least on paper) expropriation of this sort can involve compensation by the government to whoever's land they are expropriating.
What makes this story even MORE sickening is that the ACLU has extracted for ITSELF "compensation" (in the form of legal fees) from the very person it is trying to vanquish.
They are relentless and VERY SOON , I feel , they are going to go ONE STEP too far, and are going to drop that ONE STRAW, and a broken-backed camel is going to crush them underfoot. I feel it coming.

I should add that the ACLU reminds me of the kind of reckless, obnoxious, out-of-control (and might I add SADOMASOCHISTIC) type that goes to a bar, high or stoned, and starts insulting people, trying to pick fights with whoever happens to be there. Imagine this type who thinks he'll be protected no matter WHAT he says or does, because, let's just say, his father is the Chief of Police, and will send someone over to bail him out or even arrest on some pretext the people the punk is insulting.
Then imagine that one particular night he tries it in a place out of the jurisdiction , beyond city limits, of his father's bailiwick. This is the situation that the ACLU will soon be in.It's not dissimilar from Uday and Qusay Hussein, and what they were well-practiced in doing. Once that point is reached, the ACLU is not gonna know what hit 'em.
