The most crucial passage in the agreement may prove to be this one: "Each signatory must use his or her own discretion and judgment in determining whether such ['extraordinary'] circumstances exist." As a practical matter, this applies only to the Democratic signatories, since no Republican has ever voted to filibuster a Bush judicial nominee. The seven signatories, that is, have now declared that they will decide how to vote on judicial filibusters rather than take directions from the party. Two of them, Robert Byrd and Daniel Inoyue, probably did so largely to preserve "Senate tradition"; but the other five--Mary Landrieu, Joe Lieberman, Ben Nelson, Mark Pryor and Ken Salazar--are all generally moderate, and all from red states except Lieberman. Their inclinations and political interests diverge from those of Barbara Boxer, Ted Kennedy and other far-left blue-staters.
If left-wing Democrats want to filibuster another nominee, they will have to persuade Minority Leader Harry Reid to risk another nuclear confrontation and persuade at least one of the moderate compromising five, plus Byrd, Inoyue and every single uncompromising Dem, that it's worth it. It could happen, but we're not betting on it.

According to the surrender document, "We encourage the Executive branch of government to consult with members of the Senate, both Democratic and Republican, prior to submitting a judicial nomination to the Senate for consideration."...But if you want to know who really won in this disgusting episode listen to Nancy Keenan, president of NARAL Pro-Choice America, who boasted that her group was "heartened that the crisis has been averted and the right to filibuster preserved for upcoming Supreme Court nominations. We are confident that a Supreme Court nominee who won't even state a position on Roe v. Wade is the kind of 'extraordinary circumstance' this deal envisions." They think the gay marriage amendment brought out the conservative base, they haven't seen anything yet. There is a midterm election in 2006, I have a feeling the Democrats and these so-called "moderate" Republicans are going to be annihilated.

Right there with you. We get these people because the Republican leadership tolerates it. I have often thought RAT moles are in the party just for this purpose. Hell, let's run the judges and Bolton then boot McCain, Snow, and Warner out of the party. Kick them right out of the caucus. The other weasels might think twice if party discipline was properly imposed. By the way, Dick Morris thinks we are right wing extremists and so does O'Riley (however you spell that name). Alas, this thought minimizes the treachery of the tergiversate seven. The 7, especially, McCain would vote against the simple majority option, arguing that they had agreed to a deal to avoid that disruption of the Senate.
Buffoon Bill Frist wouldn't get the 50 floor votes he needed to change the rules. That is the key victory of the scumbag crapweasel dems, there can be no rules change without the turncoats taking major heat from the dem leftie extremists. And, Buffoon Bill will not have the votes to end debate should-when the dems filibuster the next nominee. They'll give away Owen, Ford and Pryor (maybe!) and consider that the cost of, in effect, naming all future judges!
