Thanks for posting. I've said it here before and I'll say it again: when people object to limits on abortion with respect to a viable fetus, they can't use thei ideas of "not forcing a woman to continue a pregnancy" and "controlling one's body" to advance the argument. Then they fall back on "who will pay for the child" as an argument. The answer is, the same people who pay for the other "unwanted" people in prisons, old age homes, mental institutions and homeless shelters - you and I. To destroy a child and then pretend it never existed is somehow deemed more palatable than giving up the child for adoption and wondering about it for the rest of the "mother's" life.

Maybe if we saved the children who were viable people would be more likely to be more responsible in their actions to start with. Does anyone not know that sex makes babies?

You had it right the first time.

Of course I did - but I also realize that our legal system has already codified that particular word substitution, so I feel compelled to re-state things in the vernacular that is more likely to be understood when discussing the issue (on the "outside") with a morality-challenged member of the legal profession.

But for the purposes of our "internal" discussions, I like to leave evidence of the "old" word in place, also.

Read an article here on FR a few weeks ago about episcopalian bishop "gene the queen". He not only approved of deviant sexual behavior but also a woman's "right to choose".

Yes, and it's obvious that a "person" was allowed to die here, especially undr the terms of this act.

What is less clear to me (because I'm no legal or medical expert) is the specific crime(s) with which someone can be charged for 'letting a person die" in this particular case. I feel there MUST be some, so I'm hoping that someone can enumerate the relevant statutes for us, along with the proscribed penalties.

United Church of Christ. They are big abortion advocates. A hospital they sponsor in Oak Lawn, IL practices "Live Birth Abortions". see testimony for H.R. 4292 for details.

In mid 1999, a young single mother of New York lost her two-month-old son who she had been regularly breast-feeding and was charged with criminally negligent homicide for the death because malnutrition was found to be the cause. However, the defendant had repeatedly tried to find help for her sick child at the Medicaid HMO HIP center where she had a card, yet was turned down for care because the infant did not have one, which was to be mailed to her, unfortunately arriving after the death. According to law, the center is not legally able to turn away a patient with or with out the possession of a card, especially a child who needs services. However, after taking the last step to save her child by rushing him via cab to the local hospital where the infant died, the mother alone was charged for the death. The center was not charged to any degree for their inadequate services, which were the most significant stages leading to the tragic death of this newborn (Whyte, 1999).

My problem with the "Manslaughter by Negligence" charge is that, after reading the statute, it's unclear to me that the abortion clinic murderersworkers could be so charged.

I believe you could so charge the doctor-owner and the doctor-practitioner, because they created the environment and the specific situation that allowed this to happen (doctor initiating the abortion not being present during the follow-up). What ISN'T clear to me is if there was anyone left on-site who was capable of rendering medical assistance. If so, they should certainly ALSO be charged.

But I'm reaching farther; in my opinion, any worker there who was aware of the situation and didn't at least attempt to call 911 probably ought to be charged with something. Maybe not convicted, but at least charged.

"A class action lawsuit, similar to that against "Big Tobacco," should be filed against "Big Abortion." Maybe they will agree to "voluntary limitations" after a big payout is delivered by state AGs..."

First of all, you would have to find a "number" (you pick it, 1, 5, 10?) of "Conservative" Attorneys Generals who would be willing to undertake this suit--and I seriously doubt you could find even 5, throughout the country.

Next of course, is that any attempt at this, would be blocked IMMEDIATELY, but some liberal Federal Judge.
