Jay is the lead Lawyer at the "American Center for Law and Justice"...the ACLJ. They are great. He is great.
Praise God the 11th has decided to review!
not me. I am actually staring at this monitor cross-eyed!! I have arthritus and my legs are swollen big time right now......so I will have to go to bed, and as Moses was pushed out into the bulrushes/water by Faith by his sister, I will have to take my Terri, and push her by faith in the basket to be rescued, in God's timing. Sure want to know before I go to bed, if the hearing is tonight though.
Hmmm. I just might think of asking my Florida friends to meet me in Biloxi.
I always say at the end of any conversation over all of this...ok, now what was MY name? (Very sweetly, if not a little bit airheady) if they don't have it, I spell it out for them give my phone number and make them repeat it all back to me. They might or might not do anything with it, but I feel like if they know I know I'm being brushed off, maybe they'll treat it more seriously if I call them on it.
Perfect Phil!!!!!!!!!
They feel that there was a clear error in the district court's ruling and that is why they are appealing. I think due to the fact that the old record was looked at and was not considered de novo.
When the poor and needy seek water, and there is none, and their
tongue faileth for thirst, I the LORD will hear them, I the God of
Israel will not forsake them.
That they may see, and know, and consider, and understand
together, that the hand of the LORD hath done this, and the
Holy One of Israel hath created it.
(Isaiah 41:17, 20)
"District Court committed plain error when it reviewed only case history not facts of the case."
basis for appeal
Ah yes, I had forgotten his alias there for a moment. Thanks for the reminder.
Donna Fiducia reporting that, now that the US Federal District Court in Atlanta had more time to consider the case, they decided the 11th Judicial Circuit (thank you, JUDGE WHITTEMORE) ERRED in NOT considering the facts of the case instead of the rulings of the state court!!!!!!!!!!!!!!!
and Phil provided to you, free of charge, a most appropriate visual of judge "because I say so" : )
FV you take care tomorrow. There might be some bad feelings from the other side after this latest news. Have you given any consideration to taking a taxi rather than having the LE follow your vehicle or tow it?
On this very happy note, I'm calling it a night before I fall asleep in the keyboard. Terri, girlfriend, you have a good night too. Prayers to hang on just a little while longer.
I am so grateful for FReepers posting prayers and Scriptures. It lifts my spirits and gives me hope. Helps me continue to believe in miracles for Terri. Thank you.
Going back to the 11th Circuit with a Motion for a Rehearing in Federal Court because the reviewing Judge(s) only looked at Greer's Court record, NOT ALL THE FACTS OF THE CASE. (and we all know what Greer's record looks likes). MAYBE TERRI WILL GET DUE PROCESS AND GET THE IV STARTED AND THEREAFTER, THE FEEDING TUBE. I don't have a timetable for this but obviously, the 11th has been made aware that this is DAY 12.
SIGNING OFF..........INTO PRAYER.
GOD BE WITH TERRI....sustain her body...keep it from damage....hydrate her supernaturally....turn what is meant for her harm into sustenance....keep those who would do her evil from being near her...bring near to her those would be kind and good....soften the hearts of the judges.....but not our will, Father, only Yours, for Your Glory and Praise, forever. Amen.
I feel we have a chance....so pray pray pray!
I heard Jay Sekulow on Hannity radio this afternoon. He said he convinced David Gibbs to take it back to the 11th.
Amen Saundra, may God be praised. He truly is our only hope, isn't He?
Terri's mom asked JJ to come. He's been following Terri's plight and speaking to the family. This was at Terri's mom's request. It's a simple as that. I'm glad he took the time. Someone else is leaving for Tallahassee. A Bishop who is black, from a Pinellas County Episcopal Church is going to Tallahassee tomorrow. Me may be going to speak to the Black Caucus in Tally.
Thanks for that info.
GibsIII has to be exhausted.
I am glad that others are stepping in to help.
Everyone anything you see on the news please post. I don't have cable, I'm counting on you.
