However, DeLay is smoking crack if he thinks Greer can be held in contempt. There's a major separation of powers issue, not to mention that the judicial branch would the one who would be asked to adjudicate the issue.It's certainly not an easy thing, but is it impossible, or should it be? Can a judge defy Congress on everything? Does separation of powers only apply in the judiciary's favor? BTW, the Constitution doesn't give the branchs equal powers, ultimately Congress has the big stick, if they choose it.

Here is what is bothering me.
This whole case is fraught with misinformation and confusion. The public is all involved, judges, now congress.
To me the central question is that if she did not have her wishes known {I have my doubts that living wills anticipate any and all of the circumstances anyway}, but if she did not, we assume that a spouse is the person who could be a stand in. I trust absolutely my husband to do that. But I trust the husband I am living with now.
So is Michael the husband that she might have trusted, is he the same husband that would logically make these kinds of decisions. All the evidence is that he is not. So his status as the guardian is very iffy in my mind.
If my husband were living another life, with another woman, I would not trust him to make decisions in my interest. That bothers me a lot, that he is the driving force, using the law and assumptions about his dedication to her best interests, assumptions that the law makes, that may be totally wrong. I also have great problems with withholding food and water. I would rather, if that is what is to be done, to have active euthanasia. But nobody can know, really, what this woman would want. And nobody being able to say that with certainty means to me, that the choice should be to preserve life, do therapy and hope for the best. She does not appear to be suffering.

I once posted years ago (on the old MSNBC bulletin boards) that liberalism=death. At the time, I was highly vilified for doing so, but now it appears that I have been vindicated. May God rescue Terri Schiavo.The point is, if you want to help her, then you must act (God helps them who help themselves). Get it?

Postman, My husband and I thought the same thing. Anyone who harms a potential witness can be charged with interference and obstruction of justice. We think (non-lawyers, folks) that even if he refused the papers, that knowing they were being issued to cover Terri puts him in the 'contempt' category. Hope so, at any rate.

The states can't get away with denying a federal constitutional right. Congress is jumping in at the right time, when it has become clear that Florida will do nothing.

In the case of Moore, I argued that he should defy what I believe was an unconstitutional and illegal order, but that he should be prepared to accept the consequences of that act.
Greer ignored a congressional subpoena and he should also face the consequences. He is in contempt and should be removed from office.

Delay is an upstanding Representative. I think he better tone down his power grabbing rhetoric a few notches before it comes back to bite him.

I am so sad for Terri...and reading their cruel posts just disgusts me. Which I am quite sure pleases them to no end.
