It's not obvious to me. Sort of tortured reasoning here. Make an unsubstantiated statement, then use it 'prove' something else.

You have evidently never been in the Military, or been audited by the IRS. I believe that these detainees have been classified as POW's, therefore don't come under the Judicial system.

They were captured on the field of battle. We simply do not ship everyone to Gitmo. No way. They are not innocent.

They are prisoners in a war. We do not hold trials and play patty-cake with POWs, so this innocent until proven argument holds no water. This is NOT a law enforcement issue (like the Clinon's approached it), this is a war and a military operations.

Big difference.

Morally? Yeah, right, the conventions were agreed with the premise that we will treat you nice if you treat us nice. If they bad guys do not adhere to the conventions then we are no longer bound by them. That is the argument why we keep to the conventions; we treat them nice so we expect our guys to be treated nice. Our guys are being abused and murdered, and the enemy is not a recognized combatant so therefore, the implied and explicit agreement is null and void. We are no longer "morally" bound to treat them any better than they treat us. . .but we do.

This angst over things that EMBARRASS them is complete and utter nonsense.
