This is a poor ruling. I'm not sure anything constitutes an unreasonable search these days.

This seems pretty consistant with prior rullings involving sniffing dogs. You don't have a reasonable expectation of privacy regarding the odors you give off. After the dog is reacting on scents that reach the inside of its nose, not what's actually in your pocket. You druggies keep your weed sealed up tight and you should be okay.

This brings up the question, again, of what the public, public property, and the State truly are. Evidently we do not understand these things correctly.

So what's to stop them from watching everything you do for hours at a time with an infrared scan? Absolutely nothing. Since they can watch you without your knowledge, it meets the "minimal intrusion" statement from the judge in the article. When they start bugging people's homes and cars and putting up cameras in neighborhoods, they'll also claim "minimal intrusion".

Hey folks...there is no right to privacy in the air. Not in the air you breath, not in the air that passes through your car. The dog simply picks up the air around the car. If it (the air)has dope or explosives or what ever the dog has been trained for, then they have probable cause for a search. It really is as simple as that. This is one of the best tools Law Enforcement has and is unintrusive and benificial for honest Law abiding citizens.

So ho wmany times did the drug warriors on this thread say something like "If you've got nothing to hide, why would you be afraid to be searched?"

..expect to see dogs used at sobriety check points. Better do a roach check of your ash trays and seats..and don't forget all those seeds and stems rolling around the carpet..oh ya..and that crack pipe you thought was so well hidden??...
