As far as I know the victim had no weapon, he was wounded and was laying on the ground. There were no signs that he was a threat. He was shot without any millitary or other reason. Of course it is possible that he belonged to the terrorists. But the marine who killed him had no possibility to verify that. To me this soldier is guilty of manslaughter and should be punished soon and hard if there is enough evidence.
I would be very happy if this stand of information could be corrected.
Maybe you should read more about the incident. A previous USMC group took fire from terrorists in the mosque and returned fire, killing something like 9 out of the 15. Weapons were cleared out and the USMC group left. The next day, another group of USMC received a report of fire from the mosque. They found these wounded terrorists and noticed movement. One was shot. Another one popped out from under a blanket, put his hands up, and surrendered.
The terrorists had been and still are using false surrenders, booby-trapped bodies, and false injuries to attack our troops. One booby-trapped terrorist killed our guys the day before. You can find plenty of documentation if you wanted to. The terrorists themselves defined the threat facing our Marine by using these tactics.
This wasn't a "CSI: Fallujah" episode where our Marines walk in with police tape, latex gloves, and test kits. It was a war filled with dirty tricks from the terrorists.
I would be very happy if this stand of information could be corrected. You have been corrected ... but I doubt if it will make a difference.

The only crime here is that there was a camera man there to see it.
The Marine comitted a possible crime by shooting the wounded insurgent, the crime was only reported because there was a cameraman there to see it.
