Gee... one would think Judge Desens would be more concerned with the illegal entry of foreign nationals onto our soil.

Eventually "The People" will become completely disillusioned with those that think of themselves as "in charge" and decide to take the future of their country in hand.

Mr. Spencer should claim Mexican ancestry and file a discrimination suit.

Maybe the rental house will be turned into a safe house for drug and immigrant smugglers after Mr. Spencer is booted out.

This ruling doesn't have anything to do with what Mr. Spencer did for a living...it has everything to do with a Property Owner's Association enforcing its CC&Rs.

No businesses run from the home. He was running his business from the home. If he was an accountant, he couldn't run that from his home, either.

It was a RENTED house, in an association-based community. If he moves into a non-association based community, he can probably find a home where he can run his business out of the house - presuming it is a legal business.

That's all this ruling was about. It was not a judgment on his activities against illegals (which I firmly support, BTW).

I wonder if Spencer even knew what the home owners associations bylaws were, since he was a renter.

You are right but I wonder how the CCR's will be enforced against the illegals? LOL

He was running a non-profit organization from what I understand. They would have left him alone if he was selling Mary Kay from his home and his pink cadillac was parked out front.

The average Homeowners Association has fascist powers the Democrats can only dream of.

Since he was renting, there's probably not much he can do but move. However, for those who own homes that a Homeowners Association busybody considers to be under its jurisdiction, what are the options? Is there any way to "opt out"?

I used to think property rights were absolute. Then I was sent a letter from someone claiming to speak for my local Homeowners Association (which I had no knowledge of when I bought the place).

From my profile:

I have updated my FMCDH (From My Cold Dead Hands) sign-off with the addition of (BITS).....Blood In The Streets, which I foresee coming soon, due to the enormous increase of the Marxist progressive movement being shoved down the throat of this failing REPUBLIC through the Judicial tyranny of fiat law, the passing of unconstitutional laws by the Legislative and Executive branches of our government and the enormous tax burden placed upon the average American to support unconstitutional programs put forth by Marxist ideology.
