At the last appearance, I thought someone said he wasn't yet arraigned, and that this would occur this coming Monday--but I might have heard wrong. It seemed peculiar to me the way the Utah courts handle these things. I think he was charged yesterday, but will be arraigned in a separate appearance. Perhaps Lady Lawyer will know if this is right.

It is a bit unusual. Usually, an arraignment establishes the defendant's identity, the charges against him and his plea. But no plea was called for or entered -- my guess is because his lawyer has a lot of prosecution material to look over before deciding how his client should proceed.

Good points you've raised. This was also in the dark. What was the instrument's resolution? How good was its infrared capability (assuming it had any)? How much lighting was in place at that dumpster?
