This is from last year some time, as I recall. Mr. Rubb made quite an impression on the viewing public.
They were using an existing provision in the vehicle code, including 27200 and 27151, to prosecute this in Oakland when this report came out. Anyone who said it was legal wasn't paying close enough attention to the vehicle code.
And in any case, they banned whistle tips specifically in the State legislature effective January 1, 2004, under CVC 27150.3. One of the problems of having a full-time legislature - they just can't resist the urge to pass new laws even though they're totally unnecessary.

I've never actually seen or heard one, to my knowledge. When I first saw the video awhile back, I thought it was a joke - not a real device.
'Round here, we don't mess with such things. If guys wanna make a ton of noise, they drive some jacked up monster truck with no muffler. Grrr...if they didn't drive them in the middle of the night it wouldn't bug me so much.
