Kerry divorce papers...hmmmm...why are they sealed?

Those papers should be released to the public. The private behavior of an individual speaks to his/her true nature.

A church annulment has no effect on the legal status of the children: if the marriage was legal (civilly), the children are legitimate, whether it was valid to the church or not.

I'm not sure that's entirely true, at least in Europe. Most patents of nobility restrict inheritance to 'male (or 'male and female') heirs of legitimate marriage' and, in those countries that required Church marriage for a marriage to be 'legitimate' there is a question of the effect of an annulment on heritabilty of children from the first marriage.

You got that right. Remember the nominating conventions of 2000. The networks claimed they got so much criticism for the briefness of coverage of the Republicans they made up for it by extending coverage for the Democrats. The left is absolutely devoid of integrity.

Obviously, marriage predates the state - any state. And, of course, there used to be much closer ties between church and state in Europe (cuius regio, cuius religio, and all). Civil law is in many ways a pretty ad hoc affair, and I seriously doubt that any European state still requires a church wedding (though I've been wrong before).

I don't feel good about this. Unless there was illegal activity involved I do not see any reason why divorce papers should be unsealed. It's a terrible can of worms for everyone involved, not to mention the children of these people. Don't we pry enough into their lives. I say let it go.

I agree, but....

Let's just be cynical for a moment. If you're John F'n Kerry, what would be the best he could hope for out of this? We've already seen the clue with his "gutterball politics" comment. His best approach is not silence, but instead to initiate a big battle. The louder this gets, the more press Kerry gets, and the more he gets to play the victim. He'll even have a chance to blame Bush for the media's prurient interest.

Wanna make a non-monetary bet on whether I'm correct?

(several years after the civil divorce) that a

I actually hope this results in some useful legislation. Sealing of Divorce records has been successfully attacked for years. The legal trend is to force them open to the public.

Divorces should NOT be public because of the use of public disclosure to as a tactic rather than reliance on facts.

I would not hestitate to predict that there would be far fewer groundless abuse allegations of all color, fewer infidelity accusations to gain financial advantage, even less id theft due to disclosures of accounts and social security numbers.

If anything it would be an incetive to keep the parties focused on the issues.

I also judes like the PR gameplaying as a means to get the parties to settle and get off their dockets.

Divorce is a public act, just as marriage is. If divorce proceedings are open to the public, I suppose the records of the proceedings should also be open to the public.
