'some kind of misconduct' could be what I mentioned, in addition to talking to Brett...talking about the case/coverage with his girlfriend, and asking if he could step out in the hall to address the press.

"Compelling? Heck no. If it hadn't been for my girlfriend giving me all the updates during the breaks and reading the news stories to me, I wouldn't have known WHAT the hell was going on!"
