bump for Terri, that she may soon experience again -- in whatever way her injuries and disability allow -- the beauties of God's earth with her family and friends.
Praying for Judge Baird as he deliberates . . . in hopes that this is not a sham, but a real finding of fact about Terri. God bless those who are working so hard for Terri with MORE than they can ask or imagine, and may this fight bring everyone of us to a closer understanding of Who is in charge, that more will live for Him. When I wonder why this drags on, that is a purpose that can be served in this spiritual battle. Not man's wisdom, but God's . . .

I'm sorry. It is a sham. "Judge" Baird himself is a "Republican" sham!!!! Baird said in October or November that he would rule against Terri's law when so permitted by the timetable of events. It's a matter of how many more days he waits to release his new death order. And the people of FL said WHAT???

With the three-year waiting period (five years with a trust), the typical strategy is to divest the patient of all assets beyond those needed for three years of care, and then, after those three years have past, only then apply for medicaid. Trouble is, I don't know if a judge overseeing a guardian would approve such divestiture.
I don't know of any other strategy, the medicaid laws are pretty sophisticated (after years of being flaunted and then retooled). Best of luck.

Even though the law clearly requires guardians of disabled persons to file comprehensive annual reports and care plans, and even though the law clearly requires guardians to not deviate from those plans, Judge Greer has virtually excused Terris adulterous husband from filing these plans and reports, a clear violation of Terri's rights and the law, especially in light of notes in Terriís records over the years that she has not been properly cared for.Think about it: If Judge Greer has not required the filing of mandated plans and reports, how could Michael Schiavo have acted legally as Terris guardian when, by law, the guardian must act within the guidelines of the filed plans? If there were no plans and all of Michael's acts were unauthorized, how could Judge Greer approve payments for Terris care?
These are HUGELY important points that I haven't seen raised before. I hope Terri's legal team reads this. Michael has not done his duty as a guardian, and the judge has let him get away with it--one more reason why the judge should have long ago been removed from the case and brought up before the bar for disciplinary action.

It can only be one of two things - MS has liquidated all of Terri's funds or, hmm, there is no other. I can't imagine they'd want to involve the state in this because that would bring in another party.
