What makes you think that Maier won't be available...

Not a thing; my point was that what we were told in the article is hearsay. Although, come to think of it, Maier's statement would still be hearsay even if he were available to testify in court, so long as Hodges is also available to testify directly as to what Akbar said to him. At least, as I understand it.
