Schwarzenegger: Gay marriage licenses illegal

A spouse may inherit 100%of the estate tax free, and also will get a stepped up basis on any real property (house, land, etc) that is part of the estate.

Anyone who inherits gets a stepped up basis - they need not be your spouse. And the person who inherits something upon your death doesn't pay the tax, your estate does. By 2010 the estate tax will be completely phased out, so this example is really moot.

Clamboat, you may have jumped on the pro-homo bandwagon, but you're not allowed to hijack the facts and hold them hostage.

Let us know when you move to CA and start paying taxes here. RINOld has reneged on his promise to not allow illegals to obtain drivers licenses(there's a new bill in the legislature which will give illegals drivers licenses that Muscle-head has said he would sign if passed)

Hey Kelly, the elction is over. McClintock LOST. He lost BIG TIME. He lost BIG TIME for the second time in less than two years. His supporters lost. His supporters lost BIG TIME. His supporters lost BIG TIME for the second time in less than a year.

When you can come up with a more substantial threat than a bill in the legislature, not even enacted, please let us know. Until then, appreciate the fact that AS got that license bill signed and repealed. I hope the rest of the ungrateful McClintock losers go to SF and jump off an orange bridge.

You may be correct about the filters, but I think this is another attempt to soften the impact of "same-sex marriages" by renaming them "same-gender marriages."

As Dennis Prager has noted, "sex" is definitive -- you're either male or female -- whereas one's "gender" refers to how one "feels" on a particular day.

Your ignorance of CA politics and the recall is laughable. Because of people like me the recall was successful. The difference between me and you is that I have a right to criticize what's happening in MY state, since I live, work and pay taxes in CA and you don't. Mind your own business and clean up MI and you'll be doing something constructive. That verbal parsing is worthy of Clinton! "the person who inherits something upon your death doesn't pay the tax, your estate does." - What BS! Like that makes a difference! The fact is the money is gone, and people to are allowed to get married by the state do not have to forfeit that tax. Talk about intentionally misleading the debate. "oh no, you don't pay the tax, the estate does, so that makes it all ok :-)".

Nope, you were right about the basis and I was wrong. Anybody who inherits property gets a stepped up basis, but unless you are the spouse, you may be taxed (depending on the value) on that property by both the feds and the state. In 2010 that tax goes away untirely, but then in 2011 it will return to levels even higher than today, barring action by congress to make the repeal permanent. We both know that married couples are treated differently, so what's to argue?

And since you want me to address every niggling point you try to make, I do not recall calling you names.

My point is that people who love each other should be allowed some form of civil union that enjoys equal treatment under the law. In 1997 the GAO identified 1,049 laws in the United States Code in which marital status is a factor (GAO/OGC Report No. 97-16). There are also thousands of state lwas that only applied to married couples. If we can find a way to treat commited couples to equal protection under the law, then yes, I am for it. I'm not wild about marriage being the only answer, but those who oppose gay marriage won't even let civil unions be recognized.

It's very simple - any single man or any single woman of the appropriate age may get married. In order to enjoy certain benefits, the law puts certain conditions on the marriage. Everyone is treated equally, they're all subject to the same conditions. No one is being discriminated against.
