The short answer is "I don't know."
The longer answer will be that even if it is legal, I will become Babysitter Extraordinaire if I'm supposed to call every month to every sub's insurance company to see if his payments are current.
What about his tax liabilities? Should I call the IRS and ask if he's paying all his taxes? Should I call the State and City and asked if he's paid all his taxes?
What about his employees' legal status? Should I hire a private investigator to determine whose employees are illegal alien? Should I hire a forgery expert to determine which sub's employees are working with phony papers?
It's bad enough as it is right now with the amount of paperwork I'm supposed to maintain. The system has become too complicated, riddled with legal pitfalls and menacing lawsuits.
Furthermore, the subs have plenty of other tricks up their sleeves. He can set up a fake answering service where a person answers preteding to be the insurance agent, for example.
As I said, this is just a mouse-and-cat game, and I realize that if the sub does not have millions to pay the lawyers, the laywers and their friendly judges will always come after the deep pockets. Everything else is irrelevant.
As for your last part I'm of the opinion that illegals should be shot as they are trying to cross the border, in other words I have no tolerance.

You know it amazes me how much we patrol the illegal Cubans coming to our country illegally while giving the Mexicans free reign.
Yes, ironic even. Cubans are offered refugee status if they make it to our shores, but the coast guard works as hard as they can to keep them out. Mexicans don't get refugee status but the Feds are lackadaisical about protecting the border.
No. Unless you are employer whose workers are required by law to be US citizens, such as contractors that provide sensitive services to the US military.
If we ask too many questions about prospective employees, or of we refuse to do business with subcontractors we suspect of hiring illegal aliens, we will get sued for discrimination against brown people
It seems employers are between a rock and a hard place. It all boils down to too much regulation, too much litigation -- too much government.

It's about time we revamp our immigration laws. For instance, I propose a simple verification system for alien numbers in green cards or blue cards.
Both the new blue card (temporary work permit) proposed by Bush, or the current green card (permanent residency) used to identify aliens eligible to work must be linked to an online system. Each blue card or green card has a unique number that can be double-checked very quickly if the ICE (Immigration and Customs Enforcement) Bureau will post the database online.
For instance, the other day I had to take my wife to a podiatrist. I asked my secretary to recommend me a doctor, and she told me about a good podiatrist she knew.
I entered the name of the recommended podiatrist in an online database of Florida doctors, and I found out that his license was on probation, because of several irregularities, such as falsifying liability insurance when he applied to join an HMO.
Needless to say, I went to another podiatrist. My secretary was shocked to learned about the doctor's record.
If green cards or blue cards information could be easily verified online against a government database of alien numbers, the verification process will be greatly simplified.
I understand that the immigration part of our federal government is the most inefficient branch of the executive branch, so this database will probably have to be farmed out to a private contractor both to create it and maintain it. Therefore, several issues need to be smooth out with Congress, but I think it's possible to work out an appropriate solution.
I think that's a very good idea. Also, since there is so much forgery of these documents, they would need to have a photo in the database also. It should apply to all types of visas.
After Katrina Horton rolled into Louisiana and bought up every available lot to build a house on, literally thousands of them. Then the Mexicans began showing up. We had some Mexicans working here prior to that but they seemed to be a little higher caliber. This new group doesn’t speak English. And now when you walk across the jobsites you see tons of empty beer bottles. THAT ALONE would be grounds for getting rid of a subcontractor. Allowing employees to drink on the job is just plain stupid and most dangereous.
I’ve had real problems working around them because they are unable to speak to us. This is actually a safety concern. If one was about to be crushed by a piece of heavy equipment we couldn’t even yell out a warning. I have been through some of the O.S.H.A. training courses and I know I remember it being a requirement that “there be a competent foreman for each crew.” Being competent would include speaking English here as far as I’m concerned.
I also have tons of problems with them destroying work we’ve done. They just either don’t care or don’t know not to run over piping in a foundation with a Bobcat. So we end up breaking concrete in houses after someone has already moved in. It’s a sad state.
Border Patrol now makes regular stops in all the Horton subdivisions around here. And now when I need to communicate with someone who only speaks Spanish I have the cell phone number to the Border Patrol agent who covers this area. He’s always happy to stop by and translate. And if they are here illegally then whatever problem I was having with them is solved immediatley.
On the other side of the coin I don’t see any locals looking around for jobs. Maybe they all aquired higher education and took those high paying white collar jobs. But somehow I doubt it.
The problem is our fault for not securring the borders. Maybe we can build a moat and fill it with alligators. But then they’d show up wearing new alligator boots. We allow companies to get away with hiring these people “on the side” and not withholding workmans comp and taxes. So how can a legitimate contractor compete with that? His labor will cost 30 percent more at least.
In stead of charging a fine for a company hiring illegals I say order them to cease doing business. Take away their license, close them down, and seize then sell their assets. The money from the sale can go to hiring new border patrol agents. If you make the penalty stiff enough and enforce it I guarantee you no one would hire anyone who is here illegally no matter what language they spoke.
