Scott Peterson pleads innocent to murder
By BRIAN MELLEY
Associated Press

MODESTO, Calif. - A trial has been set Jan. 26 for Scott Peterson, who pleaded innocent Wednesday to charges of murdering his wife and their unborn son nearly a year after her disappearance played out on a national stage.

It was the second time that Peterson, 31, has answered the charges that could send him to death row. He denied the accusations after his arrest in April and was forced to face them again after a judge decided last month there was enough evidence for prosecutors to take the case to trial.

Judge Al Girolami set the trial date and was to schedule a series of hearings for the defense to challenge wiretaps, the use of devices that tracked Peterson and cadaver-sniffing dogs used to search for Laci Peterson's scent in the boat her husband said he took fishing the day she vanished.

The defense said it would seek to move the trial out of Stanislaus County because of extensive news coverage. Last month, the judge asked both sides to research whether a jury could be selected in neighboring San Joaquin County and bused to the courthouse each day for trial.

Defense lawyer Mark Geragos, who is simultaneously representing Michael Jackson, also convinced the judge to make prosecutors return Peterson's pickup truck.

In court papers, prosecutors said they don't want to return the 2002 Ford pickup because they believe it was used in the murder of his pregnant wife and that he bled in the cab of the truck after the killing.

Stanislaus County District Attorney James Brazelton said he wants jurors to view the pickup truck as part of the crime scene because it was used to haul Laci Peterson's body to her husband's fertilizer warehouse and then to San Francisco Bay.

The defense wanted the truck returned to Peterson's family because he faces mounting legal bills and continues to pay $643 in monthly auto payments.

Blood inside truck was found on "door jam or map pocket" and "visor".

Judge is saying that there's "nothing unique" about SP's truck.

SP shook his head when the prosecution suggested how Laci's body was loaded in the back of the truck.

My guess it that the new do is not a prison haircut. Yet from the one angle I saw him, it almost looked like he had horns.

Scott Peterson's lawyer Mark Geragos (L) and sister-in-law Jayne Peterson (R) flank Scott's mother Jackie Peterson as they leave the arraignment in which Scott Peterson was charged in the Lacy Peterson murder case in Modesto, California, on December 3, 2003.

We also know that Scott was very much aware of cadaver dogs, since he saw fit to call the detective at about 3 a.m. Christmas morning and ask, "Are you using cadaver dogs in your search of the park for my wife?"

Scott is a weird bird. With some things, he seems unbelievably careless; with others, he seems meticulous and paranoid beyond belief. It would not surprise me to learn that he had studied up on cadaver dogs and how they might lose a scent, for example.
