The Journal received a denial to the Freedom of Information Lawrequest submitted Wednesday. In the letter, Simeon Moss, Deputy Director of Cornell News Service, said Cornell is not an agency of government subject to the New York Freedom of Information Law.In contrast, Robert Freeman, executive director of New York State Committee on Open Government, said reports from Cornell Police are subject to the Freedom of Information Law because members of the Cornell Police are deputized through the Tompkins County Sheriff's Office and perform government functions such as arrests.
"Cornell Police have police powers equivalent to those of local police departments," Freeman said. "Cornell Police perform what is clearly a government function."
Grace-Kobas said in a phone interview Monday that she disagreed with Freeman's statement.
"That's his opinion, not legal fact," Grace-Kobas said.
Smelling more and more like a cover up, isn't it?
In order for the incident to be classified as a bias crime, it would have to be determined that it was "a crime perpetrated solely on the basis of race or discrimination," said Capt. Curtis S. Ostrander, deputy director of the CUPD...."the law is very specific when it comes to hate crimes. There were a lot of interviews conducted -- and based on statements by the victim, eye witnesses and those accused of the crime, it was determined that the incident did not meet that criteria."
Last November, a white female student was attacked by a group of blacks on the Cornell campus following a hip hop concert. To date, little has been published about this incident, which was clearly a hate crime, and Cornell has refused to release many details.Now contrast that with the attack on Patricia Morris, a black woman, by three whites in what was evidently a personal dispute. In that case, the three attackers were charged with a hate crime. They were eventually only convicted of assault, which was the right result.
A crime is a crime and should be treated as such. However, in the People's Republic of Ithaca, it seems to depend on who is involved. White on black is automatically a hate crime, while black on white is a racial misunderstanding,
Hate crimes grant superior rights to certain select groups, rather than treating all persons equally before the law.
This politically correct atmosphere is one reason why I, who have lived in Ithaca for a quarter century, no longer call Ithaca home.
