You raise a good question here -- "...why the doctor's lawyers didn't bring it up in the "malpractice" suit?"
Why indeed? Did they not know about this? I don't know if it's germane, but the jury questioned Michael closely about how he planned to use the money for Terri's therapy, and then set damages accordingly. Maybe the parties just went along with it.

Thanks, CJ. Needless to say, that was my suspicion also. We've had witness testimony that they were having a bad fight that day. It's only too easy to imagine what happened that night. Nobody else was around, so Michael is the only possible suspect.

Michael Schiavo sealed the records. I gather the bone scan came out only ten years later, and I believe some have never been released.

Great post for sure!! After listening to Schiavo and Felos last night on LKL, I wouldn't believe a SINGLE WORD that came from Schiavo's mouth. For once also, LKL did just softball it?? His ONLY explantion for not divorcing Terri, moving on with his life and letting the parents look after her, was "to carry out her wishes". I almost screamed. We are supposed to believe HIM??

My question was prior to the "settlement" that is when the "heart attack" supposedly happened.
How was it that a heart attack was diagnosed if there was no heart attack, that is when the "help" I was referring to.

OK, I didn't understand that. You raise a telling question. It is a mystery where this "heart attack" story came from. I don't know that it was ever diagnosed, and at least two doctors today are saying it never happened, that is, there was no heart attack, no potassium issue. Perhaps it's simply something that MS told people at the time -- after all, he had to explain her collapse somehow. As a nurse or nurse-trainee, he might have been savvy enough to concoct the "potassium imbalance due to bulimia" hokum.
He wouldn't have needed many "friends" at this stage. There was no police investigation, no suspicion on him. All we had with this man who'd apparently suffered a terrible loss. The poor, poor thing.

The more I read about Michael Schiavo and what he has not done for Terri over the last 13 years and the fact that he wants her cremated with no autopsy, the more I wonder what he is trying to hide. The total lack of logic and common sense of the whole affair has my head spinning.

"the ct scan is suspicious of trauma. In an older person with osteoporosis,or someone with brain damage who was brain damaged, it could be from a fall or from minor trauma, such as transferring the patient wrong or a seizure or coughing too hard. If it was a child, we would diagnose child abuse." Or the Experimental elecro brain treatment complete with cortex implant as given to Terri by MS.(see transcript of his Larry King talk)

I still am wondering what Michael's motivation is? What he is doing does not make sense. It is obvious he has moved on with his life. That's why I believe his determination regarding ending Terri's life is much more than right to die.
There's some kind of control factor going on with this man. Did I hear someone say he has a 14 year old illegitimate child? That would be a approximately a year before Terri became ill. It seems he left Terri a long time ago.
This leaves me bewildered. Why is he so bent on fulfilling an alledged wish of only what he and his family say was what Terri wanted when he has so obviously begun a new life?
What about the cremation plans? If anything, there should be red flags popping up.

Thanks for the ping and for the transcription! I wonder who put the cap on the investigation. I noticed in one of my replies back from Jeb, he made it very clear that he respected what happened in that lower court--despite seeing for himself that the woman was no more in a coma than most liberals.
This is not to say it was he--I realize this case is much older than his term, but interesting that he refused to intervene without involving the legislature. Anyway, I'm wondering what the state ag plans to do.

GRETA: Last night, Michael Schiavo broke his silence to make his case for ending his wifes life and made some shocking accusations against Terris family. He said about Terris father, No, because hes always wanted the money. He always wanted money out of this. He even testified in the first trial he was angry that he didnt get any money."
Joining us to respond is Terris brother Bobby Schindler. Hes joined by the Schindler family attorney, Pat Anderson. Bobby, your brother-in-law says its about money. Basically, your father wants the money, thats why he doesnt want the feeding tube removed from your sister. Whats your response?
BOBBY SCHINDLER: Well, its totally false, Greta. Interestingly enough, back in 1992 Michael was suing a doctor in a malpractice trial, and he was asking up to 20 million dollars to take care of Terri for the rest of his life and the rest of her life. Shortly after the malpractice money came in, in January of 1993, it was just six months later when Michael attempted to withhold antibiotics. Terri would have died from an infection she had from a urinary tract infection. She would have died, and Michael would have inherited close to a million dollars at that time. So, this notion or this accusation that my parents were in it for money is just absolutely false and just wrong.
PAT ANDERSON: Greta, the parents want to keep Terri alive. They want to keep Terri alive. Its obvious theyre not fighting to kill her. Theyre fighting to keep her alive and get her better. It has nothing to do with money for them.
GRETA: So, whats with this money
Pat, is there
.I mean, I dont even know where the money is. I mean, I know there was a malpractice lawsuit, a successful one, but a lot of money has gone into paying for this poor womans medical care. Is there any money to be fighting over?
ANDERSON: Oh, no, no, no, no. No, the money has not gone for that purpose. The moneys gone into lawyers pockets. George Felos has received $357,000 of Terris money. Debbie Bushnell has received about another $90,000. All told, way more than half of the money that that jury awarded for Terris care has been spent on attorneys fees and costs.
GRETA: But is there any left to fight about? How about that? Pat, thats really my question.
ANDERSON: No. No.
GRETA: All right. Bobby, how would you describe your sisters marriage up until the day that she went into the hospital? What was her marriage like with her husband?
SCHINDLER: Well, it was deteriorating, Greta. I mean, Terri and I had conversations prior to her collapsing that evening when she was coming to me seeking a divorce from Michael. At the time I was only in my early 20s, and other than just listening to her, I really didnt have much to offer as far as how to go about getting a divorce. She was extremely unhappy.
GRETA: Pat, what Michael said last night is that Terri was bulimic, and that when you constantly throw up you lose a lot of potassium, and the suggestion was that what put her into cardiac arrest was a very low potassium. True or false, and whether or not she was bulimic and this may have created a potassium deficiency?
ANDERSON: Well, the doctors Ive consulted, and maybe Dr. Biden can shed some light on this, is that her potassium was below normal, but her blood glucose was quite elevated, so there is some speculation in the doctors Ive consulted is that the paramedics were running a glucose solution on her before she got to the hospital, which altered her blood chemistry to that extent. The bulimia is just a theory.
GRETA: All right, and well still keep digging into that. Bobby, do you ever talk to your brother-in-law? You ever have any conversations with him in the last six months or so?
SCHINDLER: No, not in the last six months. The last time I had contact with Michael is just prior to the original trial in January of 2000, and I asked him if hed like to talk about the upcoming trial, and at the time he told me that any conversations that we would have would be through his attorney.
GRETA: And your parents, have they
I mean, has it ever been any sort of effort for all of you to sit in the room? I mean, obviously this would become a very public and disturbing problem. Any chance that even all of you sit down and somehow work this out in Terris best interests? Bobby?
SCHINDLER: I would love
that would be wonderful if we could do something to work this out and we can get guardianship back of Terri. All we want to do is take her home and take care of her. We just want Michael to take care of his family, and we want to take care of Terri.
ANDERSON: You know, he has an infant daughter, and he needs to concentrate on it.
GRETA: All right, Pat, Bobby. Thank you both very much.

lets look at this from another angle..What if Terri had of died that night?? Would there have then been an investigation and an autopsy??? If this would have been the outcome who would have been #1 suspect?? Lots of circumstancial to convict 13 years ago and yet the court makes him guardian Sick sick sick
