IIRC, she broke it and had to pay a large penalty.
As far as I can tell, Bragg’s whole case is that Trump had wrongly recorded the payment as a legal expense instead of a contractual agreement. That’s it.
There is a portion about not reporting the payments in FEC filings, however while Trump could pay for an NDA, he could not legally use campaign funds to do so (which he did not). This has already been through the FEC, who ruled that he did it exactly how he was supposed to do so. Bragg is charging him anyway.
