It is against the Constitution for a single person to unilaterally decide a punishment without due process.
Nobody has the Constitutional authority to keep someone off of a ballot for "insurrection" before a court process finds that person guilty of insurrection.

Little-known fact—New Hampshire for years has been the go-to retirement mecca for millions of New York City pensioners of a particular political persuasion retiring on full pay at an early age from such civil service jobs as police, fire, sanitation, transportation, etc. New Hampshire is loaded with these freeloading two-hundred-thousand a year bus drivers whose contracts destroyed New York’s working class with all the taxes which were needed to fund all those union-goon retirement benefits. So this is no surprise.

. Trump need not be convicted of a crime for the 14th to be applied, just enough people need to buy into “engaged” and “insurrection”. This is exactly why the word “insurrection was chosen to describe the riot that occurred.
I knew an old man who had been a communist partisan in Albania in WW2. As a boy, he had Enver Hoxha as his schoolteacher. After the war, it was my friend’s job to try people accused of fascism — collaboration with The Axis powers. He endeavored to have fair trials and acquitted people he thought were not guilty. His superiors asked him about the acquittals and he told them that there was no evidence that those people were guilty. No, his superiors told him, all of those accused of fascism were guilty, and they suggested that he might be a fascist too. Seeing the writing on the wall, my friend escaped to Greece during its civil war, took refuge in a church and became a Christian, and eventually got to America where he had a good life.
I wish he were still around because I would like to ask him his opinion about certain aspects of our legal system.
